GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL

The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between OK RENT A CAR, S.L. (hereinafter, “Rental Company”) and the paying customer (hereinafter, “Renter”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement. In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage caused which will amount to €45 due to delay, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged 250€ for the Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of OK RENT A CAR where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. OK Rent a Car allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost: €300 for installations located in different islands where the Vehicle was rented If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the 2.1. Extension of the Agreement: The Renter must give express written notice, attending the OK RENT A CAR office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. If the Renter wanted to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of OK RENT A CAR or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge of €50 per service. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to you at the CheckOut or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver). 4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of OK RENT A CAR on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration of €50, for each one, plus payment of the possible administrative penalty imposed as a result thereof. According to certain municipal Ordinances, the document furnished to the Lessee which shows that the Vehicle is leased must also be placed in a visible spot at all times and, if this obligation is not fulfilled, said penalty must be assumed and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to OK RENT A CAR, Gran Vía Asima,36,A,- 07009,Palma, Balearic Islands, Spain. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of OK RENT A CAR or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic CDW insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in three Groups/ Segments (specifying them in the specific conditions of the Agreement): Group/Segment 1: excess of €900 (MSMS, MSAS, MMMS, MMAS, MLMS, MLAS, ESMS, ESAS) and Premium Segment (MSMP, MSAP, MMMP, MMAP, MLMP, MLAP, ESMP, ESAP); excess of €1050 (EMMS, EMAS, ELMS, ELAS) and Premium Segment (EMMP, EMAP, ELMP, ELAP) Group/Segment 2: excess of €1200 (CSMS, CSAS, CMMS, CMAS, CLMS, CLAS, WSMS, WSAS, WMMS, WMAS, WLMS, WLAS, PLMS, PSAS, PMMS, PMAS, PLMS, PLAS, SSMS, SSAS, SMMS, SMAS, TSMS, TSAS, KMMS, KLMS, KSMS, KSAS, KMAS, KLAS ) and Premium Segment (CSMP, CSAP, CMMP, CMAP, CLMP, CLAP, WSMP, WSAP, WMMP, WMAP, WLMP, WLAP, PSMP, PSAP, PMMP, PMAP, PLMP, PLAP, SSMP, SSAP, KSMP, KSAP, KMMP, KMAP, KLMP, KLAP) ; excess of €1500 (SLMS, SLAS, FSMS, FSAS, FMMS, FMAS, FLMS, FLAS) and Premium Segment (TSMP, TSAP, FSMP, FSAP, FMMP, FLMP) Group/Segment 3: excess of €1.800 (TMMS, TMAS, TLMS, TLAS, VSMS, VSAS, VMMS, VMAS, VLMS, VLAS) and Premium Segment (SMMP, SMAP, TMMP, TMAP, VSMP, VSAP, VMMP, VMAP, VLMP, VLAP) ; excess of €2.000 (TLMP, ZLMS, ZMMS, ZSMS) and Premium Segment (SLMP, SLAP), excess of €2.500 (LSMS, LSAS, LMMS, LMAS, LLMS, LLAS) and Premium Segment (FMAP, FLAP, LSMP, LSAP, LMMP, LMAP, LLMP). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €2,500, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, the administration fee of damages will be 60 euros, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +34 971 928 603, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). This cover has a minimum cost of €15; once this minimum has been exceeded €3 per day will be charged until reaching a maximum of €45. (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, PREMIUM (CAR) Road assistance, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, Groups/Segments: Group/Segment 1: This coverage has a minimum cost of €45; once this minimum has been exceeded €21 per day will be charged until reaching a maximum of €300, without going over this amount . Premium Groups/Segments 1: This coverage has a minimum cost of €50; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €375, without going over this amount. Group/Segment 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €350, without going over this amount. Premium Groups/Segments 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €30 per day will be charged until reaching a maximum of €450, without going over this amount. Group/Segment 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €35 per day will be charged until reaching a maximum of €490, without going over this amount. Premium Groups/Segments 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €40 per day will be charged until reaching a maximum of €600, without going over this amount. - Young Driver, from 19 to 25 years of age: This coverage has a minimum cost of €24; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €300, without going over this amount. - Second driver: This coverage has a minimum cost of €18; once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €70, without going over this amount. - Third driver: This coverage has a minimum cost of 3€ and a daily cost €1; until reaching a maximum of €30, without going over this amount9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of OK RENT A CAR or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from OK RENT A CAR, according to the chart below: GROUP 1: 150€; GROUP 2: 200€; GROUP 3: 250€. 10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform OK RENT A CAR of the accident by calling the emergency telephone number: +34 971 928 603. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use. It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract and must pay € 60 for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g. using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge €50 to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the management costs established at €29. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full.. 16. Authorised territory: The vehicle may only be driven in the national territory and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. 17. Mileage: On the Balearic Islands: unlimited per lease period. All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, will an additional €0.4/km, including VAT be charged. 18. Additional services and extras:. Speedy Check In: this is the fast delivery service of the Vehicle and each service costs €18. Delivery: This service has to be confirmed previously by the lessor. Prices are established according to the distance from OK RENT A CAR branch to the place of delivery or collection. Delivery Zone 0 (Airport) €20. Delivery Zone 1 (Between 0 and 20 Km) €35. Delivery Zone 2 (Between 21 and 40 Km) €45. For distances over 41km, 1€ per Km will be charged. Delivery price is per way. Delivery service subject to availability. 18.1. Extras: The Lessor offers child and baby seats, has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. GPS: has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. OK RENT A CAR only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals of Mallorca for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours(Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 24. Customer service and claims: If you want to make any suggestions about improvement of our services, you can use the email: [email protected] and additionally, all our facilities have official complaint sheets which will be given to you when requested to our employees. 25. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and OK RENT A CAR. 26. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the Spanish version. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS. INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with 2016/679 (GDPR), you are informed that the personal data here gathered will be included in filing systems of which the controller is OK RENT A CAR S.L.U The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS.- If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. These GENERAL TERMS AND CONDITIONS FOR RENTING VEHICLES(hereinafter referred to as the "General Conditions") shall govern the contractual relationship between KTIRI RENT A CAR PORTUGAL S.A.(hereinafter referred to as "Lessor" or "Ok Rent a Car") and the paying customer (hereinafter referred to as the "Lessee"), both collectively hereinafter referred to as "Parties", by means of which the former assigns to the latter the use of a vehicle (hereinafter referred to as "Vehicle") for the term, price and other conditions stipulated by the parties in the rental agreement (hereinafter referred to as the "Contract Agreement"), which shall be made and signed at the Lessor's premises. If there is any discrepancy between the content of any part of the General Conditions and that of the specific individual terms signed between the parties, then the latter shall prevail. It is the Lessee's responsibility to always keep a copy of this agreement in a place that is visible in the Vehicle.1. Purpose of the Contract Agreement:The purpose is the renting, without a driver, of theVehicle described in the specific individual terms of the Contract Agreement for the private transportation of passengers and their baggage, complying with allthe General Conditions established in this document.2. Rental period, handing over of the vehicle to the Lessee (Check-Out), return of the vehicle to the Lessor (Check-In) and extension:The minimum rental period will be 1 (one) day (24 hours) and the maximum will be determined in the Contract Agreement. Rental days will be calculated for periods of 24 hours from the exact time the Lessee receives the Rental Vehicle, keys and documentation (hereinafter "Check-Out") and until the Vehicle is returned (hereinafter "Check-In"), giving OK RENT A CAR a courtesy period of 60 minutes from the Vehicle Check-in date and time stipulated in the Contract Agreement. In the event of non-compliance with the previous period, the Lessor shall have the right to charge the rental value from the end of the Contract Agreement to the return of the Vehicle, in accordance with the Current General Tariff established in the Schedule of Prices attached to the Contract Agreement, mileage, the damages and a penalty for the economic damages (losses) caused which will be €45per day that it is late, which will be charged every day from the date that the Check-In should have been made until the return or recovery and preparation of the Vehicle. Should the Lessee abandon the Vehicle, in addition to the aforementioned amount, they will be charged €250as a recovery fee of the vehicle, plus all expenses and costs arising from its recovery. Should the Lessee Check-In before the end of the period, no amount of the price subscribed in the Contract Agreement will be returned or refunded to them, since it is considered a unilateral termination of the Contract Agreement made by the Lessee. Should the Lessee not comply with any of the items defined in the General or specific individual terms established inthe Contract Agreement, the Lessor reserves the right to withdraw the Vehicle from the Lessee at any time and may request compensation. For operational reasons of vehicle revision, the Lessor reserves the right to replace the Vehicle at any time with another of similar characteristics orfeatures, informing the Lessee in advance. Check-Out and Check-In are done at the premises of OK RENT A CAR where the Contract Agreement was executed, within the terms and conditions stipulated in the specific individual terms of the Contract Agreement. OK RENT A CAR allows the Lessee's Vehicle Check-In to be made at other company premises, different from the place where the Contract Agreement was signed (One Way fee), according to the conditions and restrictions of the service indicated on our website andin accordance with point 16, in the same terms and conditions stipulated in the specific individual terms of the Contract Agreement. The Lessee must pay €300for premises located on different officeswhere the Vehicle has been rented. If the Check-In is not done or if the Vehicle is abandoned, the Lessee will have to pay the costs plus the recovery rate of the Vehicle, plus allexpenses and costs resulting from the recovery along with the rental days that are due, in accordance with the General Tariff in force, defined on the Internet site or premises of the Lessor in the periods between the time established in the Contract Agreement as Check-In and the moment in which the actual recovery and preparation of the Vehicle is verified. 2.1. Extension of the Contract Agreement:The Lessee shall inform their intention to proceed with the extension of the Contract Agreement, expressly and in writing, appearing at the office of OK RENT A CAR where the Contract Agreement was executed, at any time before the end of the rental period stipulated in the Contract Agreement, or any other OK RENT A CAR facility, in accordance with the One Way fee conditions mentioned above. The minimum extension period will be one day (24 hours) and may be increased according to the specificindividual terms of the Contract Agreement and the Vehicle rented. At no time, shall the price at the beginning of the Contract Agreement serve or cover an extension thereof. In the event that the Lessee wishes to keep the Vehicle for a period longer thaninitially stipulated, they shall undertake to obtain prior express authorisation from the Lessor and to pay the value of the additional deposit for this extension immediately, with the price applicable to the extension period of the rental that is indicated in the Current General Tariff, defined on the website or at the premises of OK RENT A CAR or in other means or places thatit chooses. The Lessor reserves the right to refuse the extension request for operational reasons. After the end of the rental period or its extension, use of the Vehicle will be considered as a non-permitted use for the purposes of item 12 of this Agreement, and a complaint will be filed for misappropriation. The delivery or return of the Vehicle outside the opening hours (7am to 10pm)entails the payment of a mandatory fee of €50 per service. If the return or Check-in takes place at an office located at the airport, the keys to the Vehicle must be placed in the post-box indicated at the time of Check-Out or delivery of the Vehicle. 3. Driver(s):The Lessee and any additional drivers must be at least 19 years old and have held a driving license for at least one year and must present a European identity card or passport, with both documents being in force for the entire rental period, legible and in good condition and in compliance of being able to be accepted by Portuguese legislation. Insurance coverage of any young driver (between 19 and 25 years of age, included) and any additional driver (second driver and third driver) are definedunder section 9.1. 4.Vehicle Maintenance:The Lessee shall receive the Vehicle in perfect condition, and should maintain it in good condition, with no external or internal changes permitted. In the event of any change, the Lessee is obliged to return thevehicle in the original state. All damage recorded shall be charged to the Lessee. Workshop repairs or parts replacement may only be done with the express priorwritten permission of the Lessor. No repair costs will be reimbursed except with the prior consent or authorisation from the Lessor of the budget and the workshop which carries out the repair. In the absence of such express written consent, it is the sole responsibility of the Lessee to pay such expenses, both those of the workshop and any spare parts. 5. Vehicle Identification:The Lessee must keep the stickers and the registration plate holder of OK RENT A CAR on the rented Vehicle so that it can be identified. Elimination of these elements will entail a refund rate of€50 for each and also the payment of a possible administrative penalty imposed as a result. In accordance with some municipal regulations, the documentthat is given to show that the Vehicle is rented must also be placed in a visible place. Should this obligation not be observed, this sanction must be assumed, as appropriate, with payment of the administrative expenses established under paragraph 13.6. Objects found:The Lessee must remove all personal articles from the Vehicle. The Lessor shall not be responsible for objects found in the Vehicle. However, any object found in the Vehicle may be sent to the Lessee upon express written request to OK RENT A CAR at Rua General Humberto Delgado 2, 2685-340 Prior Velho, Lisbon. In this case, the Lessor will charge a minimum of 20€for the management of the shipment of the objects, as well as the costs of their sending, which shall be fully borne by the Lessee. 7. In the event of any breakdown or accident outside the stipulated rental period:Upon termination of the contractual relationship between the Parties, the Lessee shall be responsible for the entire payment for repairs and expenses incurred with the Vehicle. 8. Prices and rates:The prices of the Contract Agreement shall be adjusted to the current General Tariff that is available to the public at the premises, OK RENT A CAR websites or other means that the Lessor chooses, the contents of which the Lessee expressly declares to know in advance of this Contract Agreement, in particular the content relating to the type of vehicle and classof Contract Agreement that is signed between the Parties. All prices will be quoted and estimated in Euros (EUR). The price of the fuel will be detailed at the time of the conclusion of the Contract Agreement between the parties and owing to the variationof the price of the fuel it is impossible to indicate its value in these General Conditions. 9. If the Lessee returns the Vehicle under the same conditions asit was collected, the amount blocked will be returned. In the event of any new damage, the administrative charge for its management shall be €60, regardless of the value established in the "Table of Prices of Damage, Theft and / or Losses and Related Services". All Groups / Segments have Civil Liability for compulsory and voluntary underwriting up to €50,000,000, individual accident and legal protection. 9.1 Coverages:Tyres and Glass (CGT):Through this Contract Agreement, the Lessee can enjoy the security and tranquility of coverage for any damages of windows and tyres, these being, by their use, the most sensitive to unforeseen events or circumstances. Inappropriate use is not included. This coverage has a minimum cost of €15; if this minimum is exceeded, €10per day is charged up to a maximum of €150, without this amount being exceeded. Travel Assistance PREMIUM (CAR):This coverage covers the 24-hour phone service, through the following telephone number: 707013 149, alteration or replacement of the damaged Vehicle, assistance in travel with a tow truck, going to the accident site in the shortest time possible (it will not apply if the said accident is a result of negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or offensescommitted with it, specified under items 11 and 12). This coverage has a minimum cost of€15; if this minimum is exceeded, €3per day is charged up to a maximum of €45, without this amount being exceeded.(Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, PREMIUM (CAR) Road assistance, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, Groups/Segments: Group/Segment 1: This coverage has a minimum cost of €45; once this minimum has been exceeded €21 per day will be charged until reaching a maximum of €300, without going over this amount. Premium Groups/Segments 1: This coverage has a minimum cost of €50; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €375, without going over this amount.Group/Segment 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €25 per day will be charged until reaching amaximum of €350, without going over this amount.Premium Groups/Segments 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €30 per day will be charged until reaching a maximum of €450, without going over this amount.Group/Segment 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €35 per day will be charged until reaching a maximum of €490, without going over this amount. Premium Groups/Segments 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €40 per day will be charged until reaching a maximum of €600, without going over this amount.-Young Driver, from 19 to 25 years of age: This coverage has a minimum cost of €24; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €300, without going over this amount. -Second driver: This coverage has a minimum cost of €18; once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €70, without going over this amount. -Third driver: This coverage has a minimum cost of 3€ and a daily cost €1; until reaching a maximum of €30, without going over this amount. 9.2 General exclusions from the corresponding coverage and fees:All detailed coverage does not include the following vehicle damage related services: Structural elements; bodywork; indoor and outdoor equipment. This list is purely for informational purposes. Due to its extension, we refer to the"Price List for Damage, Theft and / or Loss and Related Services" table, which details all possible damages, thefts and / or losses and related services together with their respective prices. This table is available to the public at the premises of OK RENT A CAR and on websites or other means that the Lessor chooses, the contents of which the Lessee expressly declares to know prior to the execution of this Contract Agreement. All prices shall be quoted in Euros (EUR) and any damage, theft, losses and related services will be charged in that currency and indicated on the invoice issued in the name of the Lessee. None of the forms of coverage will include damage to the Insured Vehicle as a consequence of: wars, natural disasters and natural phenomena (hail, snowstorms, earthquakes or other), terrorism, riot or mutiny; State Security Forces actions, Renter neglect, abandonment, accident, or Vehicle stoppage due to crimes or infractions committedwith the Vehicle and any other activity set forth under items 11 and 12. These losses and related services will be borne by the Lessee. Under no circumstance does the coverage include personal belongings left, stored or transported in the vehicle.SECURITY DEPOSIT/BAIL:Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days.The amount of the deposit will be € 250regardless of the category and duration10. In the event of an accident, criminal act or vandalism (see paragraph 11) committed against the Vehicle, the Lessee is required to:a. Report the incident to the police immediately. b. Fill in a Friendly Accident Statement in accordance with the official model which is in the Vehicle,indicating at least the registration number, the name and address of the other party, as well as the name of the insurer and,where possible, the insurance policy. c. Describe, in a concise and precise manner, the accident and, if applicable, note down the names of witnesses. d. Not evaluate or acknowledge any responsibility for the accident. e. Not leave the Vehicle without taking appropriate measures to protect it from further damage, leaving it closed and without disturbing traffic. f. Report the claim to OK RENT A CAR immediately by calling the emergency phone number: 707013149. In the event of an accident or criminal act, the Lessor shall not be required to offer the Lessee another rental vehicle. The Lessor will be entitled to receive €60 for the processing of each accident report. The Lessor may make available to the Lessee a new vehicle, in accordance with current conditions and in force at the time indicated, in order to replace the vehicle that is the object of the accident, criminal act or vandalism. In this situation, the Contract Agreement will be considered as terminated between the two parties, the Lessor and Lessee, and the Lessee shall pay all expenses derived from the Contract Agreement to the Lessor. 11. Some examples of criminal acts or vandalism committed against the Vehicle:Robbery or theft of the Vehicle. Robbery or theft of exterior or interior parts of the Vehicle, such as wheels, tyres or seats. Robbery using force, causing damage to windows or to the vehicle's bodywork or chassis. Vandalism against the Vehicle. The above list is intended for illustrative purposes only and not for limitation.12. Unauthorised use of the Vehicle:It shall be the obligation of the Lessee to use the Vehicle with due diligence and care, according to its features, complyingwith the current Portuguese Highway Code and avoiding, in any event, any situation that may cause damage to the Vehicle or third parties. In addition, in any event where the provisions of this paragraph are breached, it shall be understood that there has been unauthorised use. It is the Lessee's obligation not to permit the driving of the vehicle by any person who is not authorised under this Contract Agreement and must pay €60 for this reason with the Lessee directly liable for any damage or loss to the vehicle or third parties in such case. The Lessee shall be fully liable for damage to the internal and external parts of the vehicle due to unauthorised use of the vehicle. In the event of unauthorised use of the vehicle, the Lessee is obliged to pay all expenses incurred as a result of such damages. The amount specified willbe paid by debit on the credit card of the Lessee, with theLessee giving their express agreement for all purposes. The signature of the Lessee in the Contract Agreement will be considered as the acceptance of the general and specific individual terms specified contractually. Unauthorised use includes, in particular, the following cases cited by way of example: • Participation in competitions. • Illegal races. • Driving without authorisation or driving license, or without permission of the Lessor. • Assignment of the vehicle to third parties. • Pushing or towing any other vehicle • Driving in places that are not suitable for public transport, such as on beaches, race tracks, etc. • Driving on roads susceptible to causing damage to the underside / sump of the vehicle. • Negligent conduct in relation to signaling of the indicators or warning signs on the dashboard of the vehicle that the Lessee declares they know with the signing of this Contract Agreement. • Transport of furniture, except vehicles designed for this purpose. • Transportation of animals in the vehicle •Transport of persons or property that directly or indirectly implies a payment to the Lessee (for example, using the vehicle as an illegal "Taxi"). • Sub-renting the vehicle. • Transporting persons or a greater amount of baggage than authorised for the vehicle, in accordance with the number of safety belts. • Transport of luggage on top of the vehicle (roof racks are not allowed). • Leaving objects that are visible in the vehicle. • Dirtying the vehicle above normal conditions of use. • Driving the vehiclein a state of fatigue, illness or under the influence of alcohol, medication or drugs. • Reckless driving. • Driving contrary to traffic rules. • Driving the vehicle rented by a person not authorised under the Contract Agreement, as the Lessee or additional driver. • Driving the vehicle outside the authorised territory, established under item 16 of these conditions. • Using the vehicle after the end of the rental period. • Not using a baby and / or child seat if traveling with children under 12 years of age or who are less than 135 centimeters tall. • SMOKING IS PROHIBITED INSIDE THE VEHICLE. 13. Traffic violations:The Lessee shall be responsible for paying the fines during the rental period. The Lessee shall inform the Lessor of any fineimposed on the Vehicle or the driver during the rental period. The Lessor will always charge €50 for a fine imposed on the Lessee for all notifications and notification processing of fines. Payment of fines is not included in any of the coverages that may be contracted. Inthe event that the authorities retain the Vehicle for an act or omission by the Lessee, for whatever reason, the Lessee shallbe responsible and indemnify the Lessor for all expenses and loss of profits incurred for this reason. 14. Joint responsibility:All Lessees and / or additional drivers shall be jointly and severally liable for all obligations assumed by the Lessee in the Contract Agreement and for all applicable legislation. 15. Fuel policy: At the effective time of the booking and depending on therate selected by the Renter, once of the following options shall be applied: a) Full/Refund –The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the management costs established at €29. a) Full/Full –At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory:The vehicle may only be driven in the national territory and the European Union, except for Bulgaria, RomaniaandAlbania. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought,in writing, from the Lessor. Some of our vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract onthe part of the Lessee and the appropriate legal measures shall be taken.17. Mileage:It will be unlimited mileage for rentals whose collection and return is in Portugal.All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, will an additional €0.4/km, including VAT be charged. 18. Toll Service:18.1 The lessee can purchase the Via Verde (Toll Service) from OK RENT A CAR, which ensures timely payment of toll rates due to the use of Portuguese road infrastructure (motorways and bridges), including those that only have the electronic collection system.The Toll Service (Via Verde) has a cost of € 1.85 per day up to the maximum of € 18,45 per Contract, without this amount being exceeded18.2In the event of not joining the Via Verde service, the Lesseeisresponsible for the consequences resulting from non-compliance, namely by the practice of administrative offenses punishableby a fine under the law. 18.3 If the Via Verde service is not taken up and if not done voluntarily up to the delivery of the vehicle, the customer undertakes to pay the tolls due during the term of the Contract Agreement to OK RENT A CAR, at an added costof €40 as administrative charges.18.4 By joining the Via Verde (Toll Service), the customer authorises OK RENT A CAR to pay the Toll Collection Entities the toll rates that are due for the use of the vehicle during the validity of the Rental Agreement and debit them to their credit card. These debits can be made up to 30 days after the expiration of the Contract Agreement, in cases where toll rates are only made available within that period to OK RENT A CAR.18.5 In the event that the customer who has joined the Via Verde Toll Service will subsequently, in any way, refuse or prevent OK RENT A CAR from receiving the payment of the toll rates or other associated costs, it is hereby authorised, according to the law, to identify the driver of the vehicle tothe appropriate authorities for the purposes of the respective collection and administrative infraction procedures, with the Lessee responsible for the amounts that OK RENT A CAR or other entities incur with it.19. Additional services and extras: Speedy Check-In: this is a fast delivery service of the Vehicle which has a one-time fee of €18 for each service.Delivery: This service has to be confirmed previously by the lessor. Prices are established according to the distance from OK RENT A CAR branch to the place of delivery or collection. Delivery Zone 0 (Airport) €20. Delivery Zone 1 (Between 0 and 20 Km) €35. Delivery Zone 2 (Between 21 and 40 Km) €45. For distances over 41km, 1€ per Km will be charged. Delivery price is per way. Delivery service subject to availability19.1The Lessor offers child and baby seats, has a minimum cost of €10, once this minimum has been exceeded €7per day will be charged until reaching a maximum of €100, without going over this amount. GPS: has a minimum cost of €10, oncethis minimum has been exceeded €7per day will be charged until reaching a maximum of €100, without going over this amount. 20. Payment:All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided bythe Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions ofthe Lessee's bank. OK RENT A CAR only accepts VISA and MASTERCARD credit cards and does not apply any surcharge21. Currency: The rates set by the Lessor are estimated in Euros (EUR). Payment can be made at any of our facilities in the currency you have chosen, only with the credit cards stipulated in the previous item. Under no circumstance is payment accepted in cash in any currency other than the Euro.22. Taxes:All prices stipulated in the rates include VAT (Value Added Tax) at the applicable legal rate. The Lessor is exempt from payment of any other fees or taxes that any state, autonomous or local authority may establish during this Agreement.23. Jurisdiction and Applicable legislation:This contract agreement is governed by all applicable NationalLaw. The Parties agree to submit the resolution of any litigation that opposes them arising from this agreement and which cannot be resolved in an amicable manner to the Courts of the Judicial District and may by agreement submit that resolution to an Arbitration Tribunal or Arbitration Centre specialised in consumer conflicts.24. Cancellation Policy:All cancellations must be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours(Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be madeexcept for reason of force majeure.25. Customer support and complaints: Should there be any suggestions as to improving our services, we are at your disposal through the e-mail address [email protected] and all our facilities have official complaint forms that will be kindly delivered when you ask our employees for them. 26. Master Agreement:The present conditions are a framework agreement and are applicable to all rental agreements entered into by the actual Lessee with OK RENT A CAR. 27. Translation:The Lessee is entitled to receive a copy in official languageof these General Conditions and this will be indicated in its versions written in other languages, with the languages we have at that moment, indicated in our facilities. In the event of any discrepancy, the version that shall prevail is the one written in Portuguese. 28. PRIVACY POLICY Personal data processing. In accordance with the provisions of the General Regulation on Data Protection (RGDP), approved by Regulation (EU) 2016/679, of the Parliament and of the Council, dated 20thApril 2016 and which came into force in Portugal on 25thMay 2018, it is hereby informed that the personal data collected here will be integrated into files owned by KTIRI RENT A CARPORTUGAL S.A. The personal data collected will be processed for the purpose of processing the Contract Agreement and everything related to it, namely to verify the identity, to collect amounts, monitor fraud and manage any situations that occur before, during and after the rental period. THIRD PARTY DATA. If personal data owned by third parties is provided,please confirm that consent of the persons concerned has been given, informing them in advance about the content of this privacy policy. COMMERCIAL COMMUNICATIONS. -The Lessee hereby expressly declares authorisation and acceptance that the data contained in the Contract Agreement may be assigned for the purpose of being informed, by e-mail, or by any other means, of operational and commercial information and of the performance of studies of products and services offered by KTIRI RENT A CAR PORTUGAL S.A. or by the companies that make up the OK Group or entities of the same sector, with which it collaborates, related to the entertainment, insurance, financial and automotive sectors, being able to consult with more details on our privacy policy on our website. RIGHTS OF THE DATA HOLDER. The persons concerned may exercise their rights of access, rectification, limitation, elimination and opposition in writing accompanied by a copy of their identification document and sent to the address already indicated or to the e-mail: [email protected]
The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between OK RENT A CAR, S.L. (hereinafter, “Rental Company”) and the paying customer (hereinafter, “Renter”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement. In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage caused which will amount to €45 due to delay, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged 250€ for the Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of OK RENT A CAR where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. OK Rent a Car allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost: €300 for installations located in different islands where the Vehicle was rented If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the 2.1. Extension of the Agreement: The Renter must give express written notice, attending the OK RENT A CAR office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. If the Renter wanted to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of OK RENT A CAR or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge of €50 per service. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to you at the CheckOut or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver). 4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of OK RENT A CAR on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration of €50, for each one, plus payment of the possible administrative penalty imposed as a result thereof. According to certain municipal Ordinances, the document furnished to the Lessee which shows that the Vehicle is leased must also be placed in a visible spot at all times and, if this obligation is not fulfilled, said penalty must be assumed and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to OK RENT A CAR, Gran Vía Asima,36,A,- 07009,Palma, Balearic Islands, Spain. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of OK RENT A CAR or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic CDW insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in three Groups/ Segments (specifying them in the specific conditions of the Agreement): Group/Segment 1: excess of €900 (MSMS, MSAS, MMMS, MMAS, MLMS, MLAS, ESMS, ESAS) and Premium Segment (MSMP, MSAP, MMMP, MMAP, MLMP, MLAP, ESMP, ESAP); excess of €1050 (EMMS, EMAS, ELMS, ELAS) and Premium Segment (EMMP, EMAP, ELMP, ELAP) Group/Segment 2: excess of €1200 (CSMS, CSAS, CMMS, CMAS, CLMS, CLAS, WSMS, WSAS, WMMS, WMAS, WLMS, WLAS, PLMS, PSAS, PMMS, PMAS, PLMS, PLAS, SSMS, SSAS, SMMS, SMAS, TSMS, TSAS, KMMS, KLMS, KSMS, KSAS, KMAS, KLAS ) and Premium Segment (CSMP, CSAP, CMMP, CMAP, CLMP, CLAP, WSMP, WSAP, WMMP, WMAP, WLMP, WLAP, PSMP, PSAP, PMMP, PMAP, PLMP, PLAP, SSMP, SSAP, KSMP, KSAP, KMMP, KMAP, KLMP, KLAP) ; excess of €1500 (SLMS, SLAS, FSMS, FSAS, FMMS, FMAS, FLMS, FLAS) and Premium Segment (TSMP, TSAP, FSMP, FSAP, FMMP, FLMP) Group/Segment 3: excess of €1.800 (TMMS, TMAS, TLMS, TLAS, VSMS, VSAS, VMMS, VMAS, VLMS, VLAS) and Premium Segment (SMMP, SMAP, TMMP, TMAP, VSMP, VSAP, VMMP, VMAP, VLMP, VLAP) ; excess of €2.000 (TLMP, ZLMS, ZMMS, ZSMS) and Premium Segment (SLMP, SLAP), excess of €2.500 (LSMS, LSAS, LMMS, LMAS, LLMS, LLAS) and Premium Segment (FMAP, FLAP, LSMP, LSAP, LMMP, LMAP, LLMP). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €2,500, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, the administration fee of damages will be 60 euros, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +34 971 928 603, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). This cover has a minimum cost of €15; once this minimum has been exceeded €3 per day will be charged until reaching a maximum of €45. (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, PREMIUM (CAR) Road assistance, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, Groups/Segments: Group/Segment 1: This coverage has a minimum cost of €45; once this minimum has been exceeded €21 per day will be charged until reaching a maximum of €300, without going over this amount . Premium Groups/Segments 1: This coverage has a minimum cost of €50; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €375, without going over this amount. Group/Segment 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €350, without going over this amount. Premium Groups/Segments 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €30 per day will be charged until reaching a maximum of €450, without going over this amount. Group/Segment 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €35 per day will be charged until reaching a maximum of €490, without going over this amount. Premium Groups/Segments 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €40 per day will be charged until reaching a maximum of €600, without going over this amount. - Young Driver, from 19 to 25 years of age: This coverage has a minimum cost of €24; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €300, without going over this amount. - Second driver: This coverage has a minimum cost of €18; once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €70, without going over this amount. - Third driver: This coverage has a minimum cost of 3€ and a daily cost €1; until reaching a maximum of €30, without going over this amount9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of OK RENT A CAR or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from OK RENT A CAR, according to the chart below: GROUP 1: 150€; GROUP 2: 200€; GROUP 3: 250€. 10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform OK RENT A CAR of the accident by calling the emergency telephone number: +34 971 928 603. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use. It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract and must pay € 60 for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g. using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge €50 to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the management costs established at €29. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full.. 16. Authorised territory: The vehicle may only be driven in the national territory and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. 17. Mileage: On the Balearic Islands: unlimited per lease period. All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, will an additional €0.4/km, including VAT be charged. 18. Additional services and extras:. Speedy Check In: this is the fast delivery service of the Vehicle and each service costs €18. Delivery: This service has to be confirmed previously by the lessor. Prices are established according to the distance from OK RENT A CAR branch to the place of delivery or collection. Delivery Zone 0 (Airport) €20. Delivery Zone 1 (Between 0 and 20 Km) €35. Delivery Zone 2 (Between 21 and 40 Km) €45. For distances over 41km, 1€ per Km will be charged. Delivery price is per way. Delivery service subject to availability. 18.1. Extras: The Lessor offers child and baby seats, has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. GPS: has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. OK RENT A CAR only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals of Mallorca for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours(Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 24. Customer service and claims: If you want to make any suggestions about improvement of our services, you can use the email: [email protected] and additionally, all our facilities have official complaint sheets which will be given to you when requested to our employees. 25. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and OK RENT A CAR. 26. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the Spanish version. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS. INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with 2016/679 (GDPR), you are informed that the personal data here gathered will be included in filing systems of which the controller is OK RENT A CAR S.L.U The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS.- If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. I expressly agree that the data contained in the Contract may be transferred to keep me informed either by email or by any other means as to operational and commercial information and the execution of opinion studies as to products and services offered by OK RENT A CAR S.L. or by the companies that comprise the OKGroup, or entities in the same sector with which it collaborates, in connection with the leisure, insurance, financial and automotive sectors. The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”)shall regulate the contractual relationship between Othman Ktiri Cars Deutschland GmbH (OK RENT A CAR).(hereinafter, “Rental Company”) and the paying customer (hereinafter, “Renter”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight.1. Object of the Agreement:It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document.2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hoursgranting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement.In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty foreconomic damage caused which will amount to €45due to delay, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in additionto the foregoing, they will be charged 250€ for the Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Companyreserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of OK RENT A CARwhere the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement.OK Rent a Car allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periodsand terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost.If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of theexpenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of thevehicle.2.1. Extension of the Agreement:The Renter must give express written notice, attending the OK RENT A CARoffice where the Agreement was signed at any time before the end of the rental period established in theAgreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. If the Renter wanted to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established onthe website or facilities of OK RENT A CARor other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge of €50 per service. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to you at the CheckOut or delivery of the Vehicle. 3. Driver(s):The Lessee and the additional drivers must be at least 19years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19to 25 years of age, both included) and additional drivers (second driver and third driver).4. Vehicle maintenance:The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification:The Lessee must keep the identifying stickers and registration holders of OK RENT A CARon the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration of €50, for each one, plus payment of the possible administrative penalty imposed as a result thereof. According to certain municipal Ordinances, the document furnished to the Lessee whichshows that the Vehicle is leased must also be placed in a visible spot at all times and, if this obligation is not fulfilled, said penalty must be assumed and the management expenses established in point 13 must be paid. 6. Objects found:The Renter must remove all his/her personal effects from the vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to OK RENT A CAR, , c/o Dr. Kleeberg & Partner GmbH Augustenstasse 10, 80333 München, Deutschland. In this case, the Rental Company shall charge a minimum of €20for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period:Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates:The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of OK RENT A CARor by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage:The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic CDW insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of thevehicle hired. In case of producing new damage, the administration fee of damages will be 60euros, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT):By taking outthis category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +49 (0) 8912231546, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12).This cover has a minimum cost of €15; once this minimum has been exceeded €3per day will be charged until reaching a maximum of €45.(Only in national territory. This list is merely for information purposes, due to its lengthwe must refer to the“Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of OK RENT A CARor other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones,snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident orimmobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored or transported in the vehicle. SECURITY DEPOSIT/BAIL:Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from OK RENT A CAR, according to the chart below: GROUP 1: 150€; GROUP 2: 200€; GROUP 3: 250€. 10.In the case of accident,criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform OK RENT A CARof the accident by calling the emergency telephone number: +49 (0) 8912231546.In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts oracts of vandalism against the vehicle:Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle.The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle:The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics,respecting validtraffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use.It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract and must pay € 60for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged topay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. TheRenter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way ofexample: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g. using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of thevehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if youare travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements:The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge €50 to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability.All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy:At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund –The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuellevel in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the management costs established at €29. a) Full/Full –At the Check-Out, the Rental Company must hand overthe Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter shouldbreach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full.. 16. Authorised territory:The vehicle may only be driven in the national territory and the European Union, except forBulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount.The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our vehicles are fittedwith geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shallbe terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. 17. Mileage:300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, will an additional €0.4/km, including VAT be charged. 18. Additional services and extras:. Speedy Check In: this is the fast delivery service of the Vehicle and each service costs €18.Delivery: This service has to beconfirmed previously by the lessor. Prices are established according to the distance from OK RENT A CARbranch to the place of delivery or collection. Delivery Zone 0 (Airport) €20. Delivery Zone 1 (Between 0 and 20 Km) €35. GPS: has a minimum cost of €10, once this minimum has been exceeded €7per day will be charged until reaching a maximum of €100, without going over this amount. 19. Payment:All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. OK RENT A CARonly accepts VISA and MASTERCARD credit cardsand does not apply any surcharge. 20. Currency:The rates established by the Rental Company are valued in Euros (€). Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes:All prices detailed in the rates include the correspondingVAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law:This contract is governed by all the National Legislation that affects it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals, for all incidents and issues arising from this contract, except for those related to Consumer matters, which will be governed by the jurisdiction established in their own regulations. 23. Cancellation policy:All cancellationsmust be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours(Depending on therate)prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accreditedvia web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure.24. Framework agreement:The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and OK RENT A CAR. 26. TRANSLATION:The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the versionof the official language of the country. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS.INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with 2016/679 (GDPR), you are informed that the personal data here gathered will be included in filing systems of which the controller is OK RENT A CAR. The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS.-If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. I expressly agree that the data contained in the Contract may be transferred to keep me informed either by email or by any other means as to operational and commercial information and the execution of opinion studies as to products and services offered by Othman Ktiri Cars Deutschland GmbH. or by the companies that comprise the OKGroup, or entities in the same sector with which it collaborates, in connection with the leisure, insurance, financial and automotive sectors. The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between MONZA SA commercial company which offers car rental services under the brand “OK MOBILITY” (Car Rental Division) as official franchisee in the territory of Greece (hereinafter, “Rental Company” or “Lessor”) and the paying customer (hereinafter, “Renter” or “Lessee”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement. In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage caused which will amount to €45 due to delay, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged €250 for the Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of the Rental Company where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. The Rental Company allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost: €300 for installations located in different islands where the Vehicle was rented. If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the vehicle 2.1. Extension of the Agreement: The Renter must give express written notice, attending the Rental Company’s office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. Should the Renter want to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of the Rental Company or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge of €50 per service. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to the Lessee at the CheckOut or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver).4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of RENTAL COMPANY on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration of €50, for each one, plus payment of the possible administrative penalty imposed as a result thereof. Any documents or notices which are affixed in the Vehicle in a visible spot by the Rental Company must not be removed for any reason, if this obligation is not fulfilled, a penalty may be incurred by the Lessee and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the Vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to RENTAL COMPANY, Gran Vía Asima,36,A,- 07009,Palma, Balearic Islands, Spain. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of RENTAL COMPANY or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic ¡ insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in three Groups/ Segments (specifying them in the specific conditions of the Agreement): Group/Segment 1: excess of €900 (MSMS, MSAS, MMMS, MMAS, MLMS, MLAS, ESMS, ESAS) and Premium Segment (MSMP, MSAP, MMMP, MMAP, MLMP, MLAP, ESMP, ESAP); excess of €1050 (EMMS, EMAS, ELMS, ELAS) and Premium Segment (EMMP, EMAP, ELMP, ELAP) Group/Segment 2: excess of €1200 (CSMS, CSAS, CMMS, CMAS, CLMS, CLAS, WSMS, WSAS, WMMS, WMAS, WLMS, WLAS, PLMS, PSAS, PMMS, PMAS, PLMS, PLAS, SSMS, SSAS, SMMS, SMAS, TSMS, TSAS, KMMS, KLMS, KSMS, KSAS, KMAS, KLAS) and Premium Segment (CSMP, CSAP, CMMP, CMAP, CLMP, CLAP, WSMP, WSAP, WMMP, WMAP, WLMP, WLAP, PSMP, PSAP, PMMP, PMAP, PLMP, PLAP, SSMP, SSAP, KSMP, KSAP, KMMP, KMAP, KLMP, KLAP); excess of €1500 (SLMS, SLAS, FSMS, FSAS, FMMS, FMAS, FLMS, FLAS) and Premium Segment (TSMP, TSAP, FSMP, FSAP, FMMP, FLMP) Group/Segment 3: excess of €1.800 (TMMS, TMAS, TLMS, TLAS, VSMS, VSAS, VMMS, VMAS, VLMS, VLAS) and Premium Segment (SMMP, SMAP, TMMP, TMAP, VSMP, VSAP, VMMP, VMAP, VLMP, VLAP); excess of €2.000 (TLMP, ZLMS, ZMMS, ZSMS) and Premium Segment (SLMP, SLAP), excess of €2.500 (LSMS, LSAS, LMMS, LMAS, LLMS, LLAS) and Premium Segment (FMAP, FLAP, LSMP, LSAP, LMMP, LMAP, LLMP). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €2,500, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, the administration fee of damages will be 60 euros, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +30 6 937 337 200 Heraklion station, +30 6 943 470 525 Rhodes station, +30 6 932 619 529 Chania Station, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). This cover has a minimum cost of €15; once this minimum has been exceeded €3 per day will be charged until reaching a maximum of €45. (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, PREMIUM (CAR) Road assistance, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, Groups/Segments: Group/Segment 1: This coverage has a minimum cost of €45; once this minimum has been exceeded €21 per day will be charged until reaching a maximum of €300, without going over this amount. Premium Groups/Segments 1: This coverage has a minimum cost of €50; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €375, without going over this amount. Group/Segment 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €350, without going over this amount. Premium Groups/Segments 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €30 per day will be charged until reaching a maximum of €450, without going over this amount. Group/Segment 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €35 per day will be charged until reaching a maximum of €490, without going over this amount. Premium Groups/Segments 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €40 per day will be charged until reaching a maximum of €600, without going over this amount.- Young Driver, from 19 to 25 years of age: This coverage has a minimum cost of €24; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €300, without going over this amount. - Second driver: This coverage has a minimum cost of €18; once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €70, without going over this amount. - Third driver: This coverage has a minimum cost of 3€ and a daily cost €1; until reaching a maximum of €30, without going over this amount9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of RENTAL COMPANY or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards RENTAL COMPANY, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from RENTAL COMPANY , according to the chart below: GROUP 1: 150€; GROUP 2: 200€; GROUP 3: 250€. 10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform RENTAL COMPANY of the accident by calling the emergency telephone number: +30 6 937 337 200 Heraklion station, +30 6 943 470 525 Rhodes station, +30 6 932 619 529 Chania Station. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use. It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract and must pay € 60 for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g. using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge €50 to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the management costs established at €29. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory: The vehicle may only be driven in the national territory of Malta and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lessee must contract (INT) Crossborder crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our Vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. 17. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, will an additional €0.4/km, including VAT be charged. 18. Additional services and extras: Speedy Check In: this is the fast delivery service of the Vehicle and each service costs €18. Delivery: This service has to be confirmed previously by the Lessor. Prices are established according to the distance from RENTAL COMPANY branch to the place of delivery or collection. Delivery Zone 0 (Airport) €20. Delivery Zone 1 (Between 0 and 20 Km) €35. Delivery Zone 2 (Between 21 and 40 Km) €45. For distances over 41km, 1€ per Km will be charged. Delivery price is per way. Delivery service subject to availability. 18.1. Extras: The Lessor offers child and baby seats, has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. GPS: has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash in our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Preauthorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. RENTAL COMPANY only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Courts of Malta for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected] , indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours(Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 24. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and the Rental Company. 26. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the English version. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS. INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with Regulation 2016/679 (the General Data Protection Regulation - GDPR), you are informed that the personal data here gathered will be included in filing systems of which the data controller is MONZA SA. The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS.- If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. I expressly agree that the data contained in the Contract may be transferred to keep me informed either by email or by any other means as to operational and commercial information and the execution of opinion studies as to products and services offered by MONZA SA, or entities in the same sector with which it collaborates, in connection with the leisure, insurance, financial and automotive sectors.
