GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL

The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between OK RENT A CAR, S.L. (hereinafter, “Rental Company”) and the paying customer (hereinafter, “Renter”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement. In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage cause, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged a Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of OK RENT A CAR where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. OK Rent a Car allows the Vehicle Check- In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost for One Way between the islands. If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the 2.1. Extension of the Agreement: The Renter must give express written notice, attending the OK RENT A CAR office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. If the Renter wanted to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of OK RENT A CAR or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to you at the Checkout or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, in physical format, legible and in good condition. Driving licenses in electronic or digital format will not be accepted. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver). 4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of OK RENT A CAR on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration, plus payment of the possible administrative penalty imposed as a result thereof. According to certain municipal Ordinances, the document furnished to the Lessee which shows that the Vehicle is leased must also be placed in a visible spot at all times and, if this obligation is not fulfilled, said penalty must be assumed and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to OK RENT A CAR, Gran Vía Asima,36, A,- 07009,Palma, Balearic Islands, Spain. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of OK RENT A CAR or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic CDW insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in four Groups/ Segments (specifying them in the specific conditions of the Agreement). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €4000, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, an administration fee of damages will be charged, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. The cost for this service is detailed in the attached Annex. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +34 971 928 603, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. The cost for this service is detailed in the attached Annex. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, differentiating between the different Groups/Segments established in the Annex. OK PREMIUM COVER ORIGIN: this coverage category includes Wheel and windscreen, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, differentiating between the different Groups/Segments established in the Annex. Young Driver, from 19 to 25 years of age. The cost for this service is detailed in the attached Annex. Second driver: An optional extra so that a second person can drive the vehicle. The cost for this service is detailed in the attached Annex. Third driver: An optional extra so that a third person can drive the vehicle. The cost for this service is detailed in the attached Annex. 9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of OK RENT A CAR or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored, or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from OK RENT A CAR, according to the chart per GROUP 1/ GROUP 2/ GROUP 3/ GROUP 4. 10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform OK RENT A CAR of the accident by calling the emergency telephone number: +34 971 928 603. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act, or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres, or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use. It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract, and they must pay a charge for unauthorized use of the vehicle for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g., using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine, or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge a fee to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the refueling management costs. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory: The vehicle may only be driven in the national territory, the European Union, Andorra and Gibraltar, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. The cost for this service is detailed in the attached Annex. 17. Mileage: On the Balearic Islands: unlimited per lease period. All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, an additional charge for exceeded mileage will be charged. 18. Additional services and extras: Speedy Check In: this is the fast delivery service of the Vehicle and each service has a separate cost. The cost for this service is detailed in the attached Annex. 18.1. Extras: The Lessor offers child and baby seats under the cost established in the Annex. GPS: The lessor offers GPS under the cost established in the Annex. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. OK RENT A CAR only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals of Mallorca for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 22.1. In accordance with the regulation on online dispute resolution for consumer matters (EU Regulation No. 524/2013), reference should always be made to the EU platform for online dispute resolution. It also applies, if there is no will to participate in said procedure 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours (Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 24. Customer service and claims: If you want to make any suggestions about improvement of our services, you can use the email: [email protected] and additionally, all our facilities have official complaint sheets which will be given to you when requested to our employees. 25. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and OK RENT A CAR. 26. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the Spanish version. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS. INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with 2016/679 (GDPR), you are informed that the personal data here gathered will be included in filing systems of which the controller is OK RENT A CAR S.L.U The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS. - If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. I expressly agree that the data contained in the Contract may be transferred to keep me informed either by email or by any other means as to operational and commercial information and the execution of opinion studies as to products and services offered by OK RENT A CAR S.L. or by the companies that comprise the OKGroup, or entities in the same sector with which it collaborates, in connection with the leisure, insurance, financial and automotive sectors. Further details as to our privacy policy may be consulted on our website. RIGHTS OF THE INTERESTED PARTY. Those affected may exercise their rights of access, rectification, restriction, erasure and objection by writing, enclosing a copy of their identity document, to the aforementioned postal address or the email address: [email protected] The Renter’s signature on the Agreement shall be considered as acceptance of the General and Specific Conditions specified in the agreement.

The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between KTIRI RENT A CAR PORTUGAL S.A. (hereinafter, “Rental Company”) and the paying customer (hereinafter, “Renter”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement. In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage cause, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged a Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of OK RENT A CAR where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. OK Rent a Car allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost for One Way between the islands. If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the 2.1. Extension of the Agreement: The Renter must give express written notice, attending the OK RENT A CAR office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. If the Renter wanted to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of OK RENT A CAR or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to you at the Checkout or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver). 4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of OK RENT A CAR on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration, plus payment of the possible administrative penalty imposed as a result thereof. According to certain municipal Ordinances, the document furnished to the Lessee which shows that the Vehicle is leased must also be placed in a visible spot at all times and, if this obligation is not fulfilled, said penalty must be assumed and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to OK RENT A CAR, Rua General Humberto Delgado, n.º 2, 2685-340 Prior Velho, Lisboa. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of OK RENT A CAR or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic CDW insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in four Groups/ Segments (specifying them in the specific conditions of the Agreement). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €4000, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, an administration fee of damages will be charged, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. The cost for this service is detailed in the attached Annex. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: 707013149, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. The cost for this service is detailed in the attached Annex. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, differentiating between the different Groups/Segments established in the Annex. Second driver: An optional extra so that a second person can drive the vehicle. The cost for this service is detailed in the attached Annex. Third driver: An optional extra so that a third person can drive the vehicle. The cost for this service is detailed in the attached Annex. 9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of OK RENT A CAR or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored, or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from OK RENT A CAR, according to the chart per GROUP 1/ GROUP 2/ GROUP 3/ GROUP 4. 10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform OK RENT A CAR of the accident by calling the emergency telephone number: 707013149. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act, or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres, or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever. 12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use. It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract, and they must pay a charge for unauthorized use of the vehicle for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g., using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine, or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge a fee to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the refueling management costs. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory: The vehicle may only be driven in the national territory and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. The cost for this service is detailed in the attached Annex. 17. Mileage: The mileage is unlimited for rents with pick up and drop off in Portugal. All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, an additional charge for exceeded mileage will be charged.18. Toll Service: 18.1 The Renter can acquire the Toll Service (Via Verde) in OK RENT A CAR, which guarantees the timely payment of the toll rates corresponding to the use of Portuguese road infrastructures (highways and bridges), including those that only have an electronic payment system. The Toll Service (Via Verde) has a cost that is defined in the Table of extras attached to the contract. 18.2 In case of not adhering to the aforementioned ViaVerde service, the Renter will be responsible for the consequences resulting from its non-compliance, particularly for the commission of infractions punishable by a fine in the terms of the law. 18.3 If you do not adhere to the Via Verde service and if you do not do so voluntarily until the moment of delivery of the vehicle, the client is obliged to make the payment of the corresponding tolls during the term of the Contract to OK RENT A CAR, with an additional cost for administrative costs defined in the Table of extras attached to the contract.18.4 By adhering to the Toll Service (Via Verde), the client authorizes OK RENT A CAR to proceed with the payment to the Toll Collection Entities of the toll rates corresponding to the use of the vehicle during the term of the Rental Contract and the charge your credit card. The aforementioned charges can be made up to 30 days after the end of the Contract, in the cases in which the toll rates are available to OK RENT A CAR within said period. 18.5 If the client who has joined the Toll Service subsequently rejects or prevents, by any means, OK RENT A CAR from receiving payment of the toll rates or other associated costs, it is authorized from now on, under the terms of the law, to identify the driver of the vehicle before the competent entities for the purposes of the respective collection and infringement process, for which the Renter will be responsible for the amounts incurred by OK RENT A CAR or other entities 19. Additional services and extras: Speedy Check In: this is the fast delivery service of the Vehicle and each service has a separate cost. The cost for this service is detailed in the attached Annex. 19.1. Extras: The Lessor offers child and baby seats under the cost established in the Annex. GPS: The lessor offers GPS under the cost established in the Annex. 20. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. OK RENT A CAR only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 21. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 22. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 23. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals of Mallorca for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 23.1. In accordance with the regulation on online dispute resolution for consumer matters (EU Regulation No. 524/2013), reference should always be made to the EU platform for online dispute resolution. It also applies, if there is no will to participate in said procedure 24. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours (Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 25. Customer service and claims: If you want to make any suggestions about improvement of our services, you can use the email: [email protected] and additionally, all our facilities have official complaint sheets which will be given to you when requested to our employees. 26. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and OK RENT A CAR. 27. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the Spanish version. 28. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS. INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with 2016/679 (GDPR), you are informed that the personal data here gathered will be included in filing systems of which the controller is KTIRI RENT A CAR PORTUGAL S.A The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS. - If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between OTHMAN KTIRI CARS ITALIA S.R.L.. (hereinafter, “Rental Company”) and the paying customer (hereinafter, “Renter”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement.In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage cause, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged a Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of OK RENT A CAR where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. OK Rent a Car allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost for One Way between the islands. If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the 2.1. Extension of the Agreement: The Renter must give express written notice, attending the OK RENT A CAR office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. If the Renter wanted to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of OK RENT A CAR or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to you at the Checkout or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver).4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of OK RENT A CAR on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration, plus payment of the possible administrative penalty imposed as a result thereof. According to certain municipal Ordinances, the document furnished to the Lessee which shows that the Vehicle is leased must also be placed in a visible spot at all times and, if this obligation is not fulfilled, said penalty must be assumed and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to OK RENT A CAR, via Bandini SNC, 00043 Ciampino (RM) - Italia. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of OK RENT A CAR or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic CDW insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in four Groups/ Segments (specifying them in the specific conditions of the Agreement). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €4000, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, an administration fee of damages will be charged, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. The cost for this service is detailed in the attached Annex. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: 39.06.36.15.86.04, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. The cost for this service is detailed in the attached Annex. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, differentiating between the different Groups/Segments established in the Annex. Young Driver, from 19 to 25 years of age. The cost for this service is detailed in the attached Annex. Second driver: An optional extra so that a second person can drive the vehicle. The cost for this service is detailed in the attached Annex. Third driver: An optional extra so that a third person can drive the vehicle. The cost for this service is detailed in the attached Annex.9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of OK RENT A CAR or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored, or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards OK RENT A CAR, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from OK RENT A CAR, according to the chart per GROUP 1/ GROUP 2/ GROUP 3/ GROUP 4. 10. In the case of accident,criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform OK RENT A CAR of the accident by calling the emergency telephone number: 39.06.36.15.86.04. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act, or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres, or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use.It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract, and they must pay a charge for unauthorized use of the vehicle for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g., using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine, or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge a fee to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the refueling management costs. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory: The vehicle may only be driven in the national territory and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lesser must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. The cost for this service is detailed in the attached Annex. 17. Mileage: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, an additional charge for exceeded mileage will be charged. 18. Additional services and extras: Speedy Check In: this is the fast delivery service of the Vehicle and each service has a separate cost. The cost for this service is detailed in the attached Annex. 18.1. Extras: The Lessor offers child and baby seats under the cost established in the Annex. GPS: The lessor offers GPS under the cost established in the Annex. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash on our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. OK RENT A CAR only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals of Mallorca for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 22.1. In accordance with the regulation on online dispute resolution for consumer matters (EU Regulation No. 524/2013), reference should always be made to the EU platform for online dispute resolution. It also applies, if there is no will to participate in said procedure 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected], indicating the booking number in the subject. ALLGEMEINE GESCHÄFTSBEDINGUNGEN FÜR DIE VERMIETUNG VON FAHRZEUGEN
1. Allgemeines, Vertragsinhalt
1.1. Die vorliegenden ALLGEMEINEN GESCHÄFTSBEDINGUNGEN FÜR DIE VERMIETUNG VON FAHRZEUGEN (nachfolgend: „Allgemeine Vermietungsbedingungen“) regeln die Vertragsbeziehung zwischen der Othman Ktiri Cars Deutschland GmbH, c/o Dr. Kleeberg & Partner GmbH, Augustenstraße 10, 80333 München, (nachfolgend „Vermieter“) und dessen Kunden, die Verbraucher i.S.d. § 13 BGB oder Unternehmer i.S.d. § 14 BGB sind, (nachfolgend: „Mieter“) (nachfolgend Vermieter und Mieter gemeinsam auch: „Parteien“) und die diesen bei Reservierung sowie Abschluss des Mietvertrages über ein zu mietendes Fahrzeug zugestimmt haben.
1.2. Gemäß diesen Allgemeinen Vermietungsbedingungen (nachfolgend: „AVB“) überlässt der Vermieter dem Mieter ein ausgewähltes Fahrzeug (nachfolgend: „Fahrzeug“) zur Nutzung für den privaten Transport von Personen und ihrem Gepäck während eines von den Parteien im Mietvertrag festgelegten Zeitraumes (nachfolgend: „Mietdauer“) unter Berücksichtigung der Bedingungen des Mietvertrages über das Fahrzeug (nachfolgend: „Mietvertrag“) sowie ergänzend der diesem Dokument zu entnehmenden AVB (nachfolgend: „Vermietung“). Im Gegenzug für die Vermietung des Fahrzeugs muss der Mieter eine entsprechende Gebühr an den Vermieter bezahlen (nachfolgend: „Mietpreis“).
1.3. Sofern Abweichungen zwischen den Regelungen dieser Allgemeinen AVB und den spezifischen Regelungen des Mietvertrages bestehen, sind letztere vorrangig. Der Mieter ist verpflichtet, eine Kopie des Mietvertrages ständig im Fahrzeug mitzuführen.
1.4. Anderslautende Allgemeine Geschäftsbedingungen Dritter bilden keine Rechtsgrundlage. Abweichenden Allgemeine Geschäftsbedingungen von Mietern werden hiermit widersprochen. Solche werden seitens des Vermieters nur anerkannt, wenn diese ausdrücklich schriftlich vereinbart wurden.
2. Reservierung, Vertragsabschluss, Stornierungen
2.1. Reservierung
2.1.1. Der Vermieter stellt dem Mieter die Möglichkeit zur Verfügung, Mietfahrzeuge vorab für eine vom Mieter im Rahmen der Buchung gewählte Mietdauer an einer für die Übergabe gewählten Mietwagenstation des Vermieters verbindlich für den Abschluss eines Mietvertrages (vgl. Ziff. 2.2.) zu reservieren. Dies kann entweder direkt beim Vermieter über dessen Webseite unter https://okrentacar.es/de/ oder in einer Mietwagenstation des Vermieters oder alternativ indirekt über einen Dritten wie ein Reisebüro, Onlinereiseportal oder -reisesuchmaschine, etc. erfolgen. Reservierungen sind nur für die gewählten Gruppen/Segmente von Fahrzeugen entsprechend deren Kategorie, nicht jedoch für ein spezielles Fahrzeug- bzw. einen Fahrzeugtyp verbindlich.
2.1.2. Übernimmt der Mieter das reservierte Mietfahrzeug nicht bis spätestens 60 Minuten nach der reservierten Übergabezeit entfällt die Reservierungsbindung.
2.1.3. Im Falle einer Reservierung eines Mietfahrzeugs erhält der Mieter einen Reservierungsbeleg (Voucher) den er beim Vertragsabschluss in der für die Übergabe gewählte Mietwagenstation des Vermieters vorzulegen hat.
2.2. Vertragsabschluss. Der Abschluss des Mietvertrages über ein Fahrzeug erfolgt in den Geschäftsräumen der Mietwagenstation, an welcher das Fahrzeug übernommen wird durch Unterzeichnung eines entsprechenden Mietvertrages durch den Mieter, Vermieter sowie weitere Fahrer (vgl. Ziff. 3).
2.3. Stornierungen und Umbuchungen
2.3.1. Dem Mieter steht nach § 312g Abs. 2 Nr. 9 BGB kein Widerrufsrecht hinsichtlich des Mietvertrages zu. Dies gilt entsprechend für die Reservierung, d.h. eine Stornierung der Buchung durch Widerruf seiner Willenserklärung ist nicht möglich.
2.3.2. Abweichend von Ziff. 2.3.1. hat der Mieter, sofern er sich während der Reservierung nach Ziff. 2.1.1. auf der Webseite des Vermieters unter https://okrentacar.es/de/ für einen stornierbaren Mietwagentarif entscheidet und worauf der Mieter bei Reservierung ausdrücklich hingewiesen wird, die Möglichkeit, bis zu 48 Stunden vor Beginn der Mietdauer (oder entsprechend der Regelungen seines bei der Reservierung gewählten Mietwagentarifs) in Textform die Reservierung des Fahrzeugs zu stornieren. Hierfür muss der Mieter eine E-Mail an [email protected] unter Angabe der Reservierungsnummer im Betreff schicken. Bei stornierbaren Mietwagentarifen erfolgt eine Rückerstattung von bereits durch den Mieter geleisteten Zahlungen (vgl. Ziff. 4.) in Höhe von 100%, wenn der Stornierungsantrag rechtzeitig entsprechend S. 1 gestellt wurde. Bei nicht stornierbaren Mietwagentarifen erfolgt eine Rückerstattung nach rechtzeitigem Stornierungsantrag nach S. 1 nur im Falle höherer Gewalt (beispielsweise Naturkatastrophen, Krieg, Attentate, Tod), soweit die geleisteten Zahlungen des Mieters den Mietpreis nach Ziff. 4. des gewählten Fahrzeugs (inkl. Zusatzleistungen, Extras) für drei Miettage nicht überschreitet. Sofern keine Stornierung der Reservierung erfolgt und der Mieter das Fahrzeug zur vereinbarten Übergabezeit bzw. bis zu 60 Minuten danach nicht abholt, erfolgt keine Rückerstattung bereits geleisteter Zahlungen, es sei denn der Mieter hat dies nicht zu vertreten. Dem Mieter wird der Nachweis gestattet, dass dem Vermieter hierdurch ein niedrigerer Schaden oder gar kein Schaden entstanden ist. Darüber hinaus kann der Vermieter über seine Vertriebsmittler und Partner weitere Möglichkeiten hinsichtlich der Stornierung von Mietwagentarifen anbieten.
2.3.3. Nach Abschluss des Mietvertrages besteht grundsätzlich kein Recht des Mieters, hierbei gewählte Optionen (wie z.B. Mietwagenklasse, Tarif etc.) nachträglich zu ändern oder umzubuchen. Hiervon ausgenommen sind Änderungen von Vor- oder Nachnamen des Mieters, sofern diese nicht zu einem Wechsel der Vertragspartei führen, sowie die Zubuchung von Zusatzleistungen oder Extras entsprechend dieser AVB oder sofern in diesen AVB ausdrücklich etwas Abweichendes bestimmt ist.
3. Fahrer
3.1. Das zur Verfügung gestellte Fahrzeug darf neben dem Mieter nur von dem im Mietvertrag als Fahrer angegebenen Personen geführt werden (nachfolgend: „Fahrer“). Hinsichtlich der Zusatzkosten für etwaige zusätzliche Fahrer (zweiter und/oder dritter Fahrer) sowie junge Fahrer (Fahrer, die zwischen 19 und 25 Jahre alt sind) (nachfolgend: „Junge Fahrer“) wird auf Ziff. 12.2.3. verwiesen.
3.2. Der Mieter und der Fahrer müssen mindestens 19 Jahre alt sein und dürfen maximal 75 Jahre alt sein. Weiterhin erforderlich ist, dass der Mieter und der Fahrer seit mindestens einem Jahr ohne Unterbrechung im Besitz eines in Deutschland gültigen europäischen Führerscheins sind, davon ausgenommen sind kurzzeitige Fahrverbote von bis zu einem Monat, die in Summe einen Zeitraum von drei Monaten nicht überschreiten, und gegebenenfalls alle darin enthaltenen Bedingungen und Auflagen erfüllt. Der Verlust des Führerscheins, ein Fahrverbot, die Sicherstellung oder Beschlagnahme des Führerscheins oder ähnliches während der Mietdauer ist dem Vermieter unverzüglich anzuzeigen und das Führen des Fahrzeugs strikt zu unterlassen. Der Führerschein des jeweiligen Mieters und Fahrers ist neben einem für die Mietdauer gültigen europäischen Personalausweis oder Reisepass bei Abschluss des Mietvertrages dem Vermieter vorzulegen.
3.3. Das Fahrzeug darf von dem Mieter und den Fahrern ausschließlich in fahrtüchtigem Zustand geführt werden, das heißt, das Fahren unter Alkoholeinfluss (0,00 ‰), Drogen, Medikamenten, sowie aufgrund von Müdigkeit oder Krankheit oder sonstigen Faktoren, welche die Fahrtüchtigkeit beeinflussen können, ist strikt zu unterlassen.
3.4. Der Mieter muss dafür Sorge tragen, dass die Pflichten dieser AVB von allen Fahrern zu jeder Zeit eingehalten werden. Weiterhin besteht die Pflicht des Mieters vor jedem Fahrtantritt zu überprüfen, ob der jeweilige Fahrer fahrtauglich ist, sowie weiterhin einen gültigen Führerschein besitzt. Der Mieter haftet für das Handeln aller Fahrer, wie für eigenes Verschulden.
4. Preise, Kaution, Zahlungsbedingungen
4.1. Der Mietpreis setzt sich zusammen aus einem Basismietpreis für die Überlassung des Fahrzeugs während der Mietdauer sowie Zusatzleistungen oder Extras entsprechend dieser AVB. Maßgeblich für den Basismietpreis ist, sofern im Mietvertrag nichts Abweichendes bestimmt ist, die zum Zeitpunkt des Abschlusses des Mietvertrages gültige Allgemeinen Gebührenordnung des Vermieters, welche in den Mietwagenstationen des Vermieters ausliegt sowie auf der Website des Vermieters unter https://okrentacar.es/de/ abrufbar ist oder in sonstigen, vom Vermieter für angemessen erachteten öffentlich zugänglichen Medien veröffentlicht wird, über die der Mieter bei Abschluss des Mietvertrages informiert wird. In dieser sind alle Mietwagentarife des Basismietpreises enthalten. Der Mieter ist verpflichtet, sich vor Abschluss dieses Mietvertrages über den Inhalt dieser allgemeinen Gebührenordnung zu informieren. Alle Preise werden in EUR angegeben und berechnet.
4.2. Mit dem Mietpreis sind grundsätzlich alle im Rahmen der jeweiligen Vermietung erbrachten Leistungen abgegolten, sofern sich aus dem Mietvertrag oder diesen AVB nichts anderes ergibt. Dies gilt nicht, sofern sich im Nachhinein herausstellt, dass ein Schaden oder Mangel nach Ziff. 13. vorliegt. Während der Mietdauer ist der Mieter selbst für die Kosten der Betriebsflüssigkeiten (z.B. Kraftstoffe, AdBlue, Scheibenwischwasser, Motoröl), der Kosten für Maut, sowie Kosten der Reinigung und Pflege des Fahrzeugs verantwortlich. Diese sind nicht vom Mietpreis erfasst und vom Mieter selbst zu tragen. Der Mieter trägt die Verantwortung alle erforderlichen Betriebsflüssigkeiten nach der Betriebsanleitung des Fahrzeugs nachzufüllen und dies entsprechend zu kontrollieren.
4.3. Der Mietpreis sowie alle vorab gewählten Zusatzleistungen und Extras entsprechend diesen AVB sind zum Beginn der Mietdauer fällig und müssen im Voraus bei Abschluss des Mietvertrages mit Kreditkarte (VISA oder MASTERCARD), Debitkarte oder bar in der betreffenden Mietwagenstation bezahlt werden. Über die Webseite des Vermieters erfolgte Reservierungen können nur mit den in der Reservierung angegebenen Kredit- oder Debitkarte bezahlt werden, eine Barzahlung ist ausgeschlossen. Im Falle einer Zahlung mit Kredit- oder Debitkarte autorisiert der Mieter den Vermieter die angegebene Zahlungsart zu belasten. Zahlungsbeträge werden dabei auf folgendes Konto des Vermieters eingezogen: ES39-0049-1853-1921-1047-8461. Die vom Vermieter festgelegten Preise werden in Euro (EUR) angegeben und im Falle einer Barzahlung mit Hilfe des Währungsrechners https://www.google.com/finance/converter auf Wunsch des Mieters in jedwede andere Währung umgerechnet, sodass jede Art von Umrechnungsfehler nicht in der Verantwortung des Vermieters liegt.
4.4. Zusätzlich ist der Mieter verpflichtet, zu Beginn der Mietdauer eine Kaution zu leisten. Hierfür wird nach Vorabautorisierung des Mieters gegenüber dem Vermieter der entsprechende Betrag der Kaution auf einer vom Mieter zu benennenden Kreditkarte des Mieters oder eines den Mietvertrag ebenfalls unterzeichnenden Fahrers für die Mietdauer sowie bis zu 30 Tage danach blockiert. Diese Kaution dient der Sicherstellung sämtlicher Ansprüche des Vermieters gegenüber dem Mieter aufgrund der Vermietung des Fahrzeugs. Der Betrag der Kaution wird nur dann entsprechend Ziff. 4.3. von der Kreditkarte des Mieters abgebucht, sollte der Mieter seine Pflichten gegenüber dem Vermieter nicht erfüllen. Andernfalls wird der geblockte Betrag innerhalb einer Frist von maximal 30 Tagen nach Beendigung des Mietvertrages wieder freigegeben. Die Höhe der Kaution wird entsprechend der Fahrzeugkategorie des reservierten Fahrzeugs berechnet und untereilt sich in 4 unterschiedliche Gruppen/Segmente entsprechend der Fahrzeugkategorie, welche im Mietvertrag vermerkt ist. (GRUPPEN 1 bis 4)
4.5. Eventuell angefallene Bußgelder wegen Verkehrsverstößen entsprechend Ziff. 15. werden dem Mieter sofort nach Erhalt des Verstoßes in Rechnung gestellt. Etwaig anfallende Bußgelder wegen Verkehrsverstößen nach Ziff. 15., die der Mieter oder Fahrer begangen haben, können auch noch nach Ablauf der Mietdauer in Rechnung gestellt werden.
4.6. Die Rechnungen werden ausschließlich in elektronischer Form an eine vom Mieter bei Abschluss des Mietvertrages angegebenene E-Mail-Adresse versandt.
4.7. Bei Zahlungsverzug behält sich der Vermieter vor, pauschale Mahngebühren als Verzugsschaden in Höhe von EUR 5,00 zu erheben. Dem Mieter wird dabei der Nachweis gestattet, dass ein niedrigerer Schaden als die Pauschale oder gar kein Schaden entstanden ist.
5. Zusätzliche Serviceleistungen und Extras Der Mieter kann bei Abschluss des Mietvertrages zusätzlich nachfolgende Serviceleistungen und Extras buchen:
5.1. Speedy Check-In: Der Mieter wird bei Übergabe des Fahrzeugs vorrangig berücksichtigt. Die Kosten für diesen Service sind im beigefügten Anhang aufgeführt.
5.2. Kindersitze: Der Vermieter bietet Baby- und Kindersitze zu den in der Tabelle der Extras festgelegten Kosten an. 18.4. GPS: Der Vermieter bietet Ihnen ein GPS/Navigations System zu den in der Tabelle der Extras festgelegte Kosten an.
6. Kilometerregelung
In dem Basismietpreis nach Ziff. 4.1. ist die kilometermäßig unbegrenzte Nutzung des Fahrzeugs in Deutschland enthalten. In den zulässigen Gebieten nach Ziff. 10. kann das Fahrzeug 300 km pro Miettag bis zu einer Höchstgrenze von 3.000 km genutzt werden. Nach Überschreitung der vorgenannten Höchstgrenze fällt eine zusätzliche Gebühr die in der Tabelle der Extras aufgeführt ist.
7. Tankregelung
Der Vermieter prüft bei Übergabe des Fahrzeugs zu Beginn der Mietdauer den tatsächlichen Füllstand des Tanks und notiert diesen sowie den aktuellen Kraftstoffpreis auf dem Mietvertrag. Der Mieter kann dann hinsichtlich der Tankregelung zwischen den nachfolgenden Alternativen wählen:
7.1. Voll/Voll: Der Mieter erhält das Fahrzeug mit vollem Tank und gibt es mit vollem Tank zurück. Falls der Mieter das Fahrzeug nicht mit vollem Tank ausgehändigt erhält, kann er bei der Übergabe des Fahrzeugs (Check- Out) verlangen, dass der Vermieter ihm das Fahrzeug mit vollem Tank übergibt. Falls der Mieter bei Übergabe den Tankstand nicht reklamieren sollte, gilt das Fahrzeug als vertragsgemäß mit vollem Tank übergeben. Gibt der Mieter das Fahrzeug bei der Rückgabe (Check-In) nicht vollgetankt zurück, wird ihm eine Verwaltungs- und Servicegebühr für die Befüllung des Tanks zzgl. des Preises des Kraftstoffes für die Vollfüllung des Tanks entsprechend des vereinbarten Kraftstoffpreises berechnet. Die Kosten für diesen Service sind im beigefügten Anhang aufgeführt.
7.2. Voll/Erstattung: Der Mieter erhält das Fahrzeug entsprechend Ziff. 15.1. mit vollem Tank. Für die Rückgabe (Check-In) kauft der Mieter bereits bei Übergabe (Check-Out) des Fahrzeugs einen vollen Tank entsprechend des im Mietvertrag vereinbarten Kraftstoffpreises, sodass der Mieter berechtigt ist, das Fahrzeug mit leerem Tank zurückzugeben. Gibt der Mieter das Fahrzeug zurück, ohne dass der Tank ganz leer ist, erstattet der Vermieter dem Mieter die Differenz des Tankinhalts bei Check-In und des vollen Tankinhalts bei Check-Out gemäß der Tankanzeige in Achtel entsprechend des vereinbarten Kraftstoffpreises, abzgl. einer Verwaltungspauschale die in der Tabelle der Extras aufgeführt ist. Dem Mieter wird der Nachweis gestattet, dass dem Vermieter hierdurch ein niedrigerer Schaden als die Verwaltungspauschale oder gar kein Schaden entstanden ist.
8. Übergabe (Check-Out) und Rückgabe (Check-In) des Fahrzeugs
8.1. Übergabe
8.1.1. Die Übergabe des Fahrzeugs (nachfolgend auch: „Check-Out“) findet in der Regel an der bei der Reservierung ausgewählten Mietwagenstation des Vermieters bei Abschluss des Mietvertrages am ersten Tag der Mietdauer statt. Der Mieter kann im Regelfall gemäß Satz 1 das Fahrzeug ab dem ersten Tag der Mietdauer zu den üblichen Geschäftszeiten der Mietwagenstation des Vermieters (7:00 bis 22:00 Uhr) abholen.
8.1.2. Bei der Übergabe des Fahrzeugs erhält der Mieter auch die entsprechenden Fahrzeugdokumente, insbesondere die Zulassungsbescheinigung Teil I („Fahrzeugschein“).
8.1.3. Der Gefahrübergang an den Mieter erfolgt mit der Übergabe des Fahrzeugs und damit verbundener Protokollierung des Fahrzeugzustands durch einen Mitarbeiter des Vermieters auf dem Mietvertrag unter dem Punkt „Fahrzeugzustand” (nachfolgend: „Fahrzeugprotokoll”). Dies gilt auch im Falle eines Delivery nach Ziff. 5.2. Im Rahmen des Fahrzeugprotokolls wird das Fahrzeug durch einen sachkundigen Mitarbeiter des Vermieters besichtigt und eventuelle Schäden festgehalten.
8.2. Rückgabe
8.2.1. Die Rückgabe des Fahrzeugs (nachfolgend auch: „Check-In“) muss bis zum letzten Tag der Mietdauer erfolgt sein. Klargestellt wird, dass eine vorzeitige Rückgabe vor Ende der Mietdauer zu keiner Kostenerstattung betreffend den Mietpreis sowie die Preise für etwaige Zusatzleistungen/Extras durch den Vermieter führt. Die Rückgabe findet grundsätzlich am letzten Tag der Mietdauer an der im Mietvertrag festgelegten Rückgabe- Mietwagenstation des Vermieters zu deren üblichen Geschäftszeiten (7:00 bis 22:00 Uhr) bis spätestens zu der im Mietvertrag vereinbarten Rückgabeuhrzeit statt. Der Vermieter gesteht dem Mieter ein Überschreiten der vertraglich festgelegten Rückgabeuhrzeit um zusätzliche 60 Minuten zu.
8.2.2. Der Vermieter bietet dem Mieter die Option, dass das Fahrzeug an einer anderen Mietwagenstation des Vermieters abgeben werden kann, als in jener, welche im Mietvertrag vereinbart wurde (sog. One Way Fee). Hierfür kann sich der Mieter auch noch nach Abschluss des Mietvertrages während der Mietdauer entscheiden. In diesem Fall hat der Mieter den Vermieter umgehend via E-Mail an [email protected] unter Angabe seiner Mietvertragsnummer hierüber sowie über die gewünschte Rückgabestation zu informieren. Die One Way Fee orientiert sich an der Übergabe- sowie Rückgabestation sowie deren Entfernung und ergibt sich aus der Preistabelle „One Way Fee“ des Vermieters, welche in den Mietwagenstationen des Vermieters ausliegt sowie auf der Website des Vermieters unter https://okrentacar.es/de/ abrufbar ist oder in sonstigen, vom Vermieter für angemessen erachteten öffentlich zugänglichen Medien veröffentlicht wird, über die der Mieter bei Abschluss des Mietvertrages informiert wird. Die One Way Fee bei Rückgabe des Fahrzeugs zu entrichten. Im Übrigen gilt Ziff. 8.2.1. Sofern der Mieter abweichend von S. 2 und 3 den Vermieter vorab nicht darüber informiert hat, dass er das Fahrzeug an einer anderen Rückgabestation zurückgeben möchte, fällt zusätzlich zur One Way Fee eine pauschale Strafgebühr an (National & Intenational), die ebenfalls bei Rückgabe des Fahrzeugs zu entrichten ist. Die Geltendmachung weiteren Schadensersatzes insbesondere für Mängel oder Schäden am Fahrzeug bleibt ausdrücklich vorbehalten. Dem Mieter wird dabei der Nachweis gestattet, dass ein niedrigerer Schaden als die Strafgebühr oder gar kein Schaden entstanden ist.
8.2.3. Im Falle der Nichteinhaltung der vorgenannten Frist für die Rückgabe des Fahrzeugs, ist der Vermieter berechtigt, gegenüber dem Mieter eine pauschale Weiternutzungsgebühr als Verzugsschaden geltend zu machen. Diese setzt sich zusammen aus einem pauschalen Weiternutzungsmietpreis für die Tage der Weiternutzung des Fahrzeugs ab dem im Mietvertrag vorgesehenen Rückgabedatum bis zur tatsächlichen Rückgabe des Fahrzeugs an den Mieter, der sich gemäß dem Allgemeinen Tarif aus der allgemeinen Gebührenordnung des Vermieters (vgl. Ziff. 4.1.) berechnet, einer pauschalen Strafzahlung pro weitergenutztem Tag sowie einer pauschalen Kilometergebühr die in der Tabelle der Extras aufgeführt ist, für Kilometer außerhalb der Mietzeit zusammen. Kilometer außerhalb der Mietzeit werden dabei, gleichgültig, ob der Mieter rein tatsächlich nach Ende der Mietzeit mit dem Fahrzeug gefahren ist, pauschalisiert anhand der Tageshöchstkilometerzahl nach Ziff. 6, wie folgt berechnet: [(Kilometerstand Check-In – Kilometerstand Check-Out) – 300 * Anzahl der gesamten Nutzungstage des Fahrzeugs (bis maximal 3.000)] * EUR 0,40. Erfolgt binnen zwei Wochen nach dem im Mietvertrag vereinbarten Rückgabetermin keine Rückgabe des Fahrzeugs oder lässt der Mieter dieses an einem nicht für die Rückgabe bestimmten Ort nach dem vereinbarten Rückgabetermin zurück, wird der Vermieter das Fahrzeug orten, um dessen Standort zu bestimmen und dieses wiederzulangen. Hierfür wird eine zusätzliche Gebühr zzgl. aller weiterer tatsächlicher Kosten für die Wiedererlangung des Fahrzeugs fällig. Die Geltendmachung weiteren Schadensersatzes insbesondere für Mängel oder Schäden am Fahrzeug bleibt ausdrücklich vorbehalten. Der Vermieter behält sich ebenfalls ein etwaiges strafrechtliches Vorgehen gegen den Mieter aufgrund der unberechtigten Weiternutzung nach Vertragsende vor. Die vorgenannte Weiternutzungsgebühr wird nicht erhoben, soweit der Mieter nachweist, dass er die verspätete Rückgabe des Fahrzeugs nicht zu vertreten hat. Dem Mieter wird dabei der Nachweis gestattet, dass ein niedrigerer Schaden als die Weiternutzungsgebühr oder gar kein Schaden entstanden ist.
8.2.4. Für die Rückgabe des Fahrzeugs außerhalb der Geschäftszeiten der Mietwagenstationen des Vermieters (22:00 bis 7:00 Uhr) fällt ein „out of hours“ Zuschlag an. Wenn die Rückgabe außerhalb der Geschäftszeiten des Vermieters an einer Mietwagenstation des Vermieters am Flughafen erfolgt, muss der Mieter den Fahrzeugschlüssel in den Briefkasten der Mietwagenstation legen, der ihm bei der Fahrzeugübergabe angezeigt wird.
8.2.5. Bei der Rückgabe des Fahrzeugs wird ein Rückgabeprotokoll entsprechend Ziff. 8.1.3. im Rahmen des Rückgabevertrages aufgenommen. Das Fahrzeug muss bei der Rückgabe und Begutachtung im Rahmen des Rückgabeprotokolls in einem einwandfreien, unfallfreien, mangel- und schadensfreien, vollständigen, der vertragsgemäßen Fahrleistung und Nutzung nach Ziff. 9. entsprechenden verkehrs- und betriebssicheren Zustand sein. Dazu gehört auch der gleiche Sauberkeitszustand des Fahrzeugs, wie bei der Abholung, sowie eine Betankung entsprechend der Tankregelung nach Ziff. 7. Außerdem müssen alle Schlüssel, alle überlassenen Dokumente (Serviceheft und Zulassungsbescheinigung Teil I („Fahrzeugschein“)) vorhanden sein.
8.2.6. Entspricht das Fahrzeug nicht den in Ziff. 9. benannten Anforderungen, so ist der Mieter zum Ausgleich des entstandenen Schadens nach Reparatur/Instandsetzung durch den Vermieter verpflichtet. Der Vermieter wird dem Mieter die Kosten der Schadensregulierung nach deren Durchführung entsprechend in Rechnung stellen. Eine Ausgleichspflicht besteht dabei insbesondere für Abnutzungsspuren, die über einen normalen Gebrauch hinausgehen. Der Abonnent haftet dann nicht, wenn der Schaden von der vorhandenen Kfz-Versicherung nach Ziff. 12. abgedeckt sind, ausgenommen davon ist die Zahlung der Selbstbeteiligung.
8.2.7. Das Recht zur Geltendmachung von bei der Rückgabe nicht zu erkennenden Schäden oder Mängeln („verdeckten Mängel“) durch den Vermieter bleibt davon unberührt.
8.3. Verlorene oder liegen gelassene Gegenstände Der Mieter hat nach Rückgabe des Fahrzeugs entsprechend Ziff. 8.2. alle seine persönlichen Gegenstände aus dem Fahrzeug zu entfernen. Der Vermieter haftet außer in den Fällen von Ziff. 16. grundsätzlich nicht für im Fahrzeug vergessene oder liegengelassene persönliche Gegenstände des Mieters (nachfolgend: „vergessene Gegenstände“). Unbeschadet dessen versucht der Vermieter alle im Fahrzeug vergessenen Gegenstände, die von diesem nach Rückgabe des Fahrzeugs aufgefunden werden, dem Mieter zukommen zu lassen. Der Mieter hat hierzu den Vermieter in Textform an [email protected] über vergessene Gegenstände sowie die entsprechende Adresse, an welche etwaige aufgefundene vergessene Gegenstände versandt werden können, zu informieren. Für die Bearbeitung einer entsprechenden Anfrage fällt eine pauschale Bearbeitungsgebühr in Höhe von EUR 20 zzgl. der Versandkosten für die vergessenen Gegenstände an, welche vollständig vom Mieter zu tragen sind.
9. Wartung/Pflege des Fahrzeugs, Vertragsgemäße Nutzung
9.1. Der Mieter verpflichtet sich, das Fahrzeug während der Mietdauer mit bestmöglicher Sorgfalt und Umsicht gemäß den Merkmalen des Fahrzeugs unter Berücksichtigung der deutschen Straßenverkehrsordnung zu nutzen, Situationen, die Schäden am Fahrzeug oder an Dritten hervorrufen können, sind dabei stets zu vermeiden (nachfolgend: „vertragsgemäßen Nutzung“). Die vertragsgemäße Nutzung meint insbesondere,
9.1.1. das Führen bzw. die Nutzung des Fahrzeugs nur durch autorisierte Fahrer entsprechend Ziff. 3.,
9.1.2. das Führen des Fahrzeugs entsprechend den Bestimmungen dieser AVB sowie des Mietvertrages,
9.1.3. die Behandlung des Fahrzeugs entsprechend der Betriebsanleitung und den maßgeblichen Vorschriften und technischen Regeln (z.B. keine Nutzung des Fahrzeugs mit zu niedrigem Kühlwasser- oder Motorölstand),
9.1.4. das Halten des Fahrzeugs in einem verkehrs- und betriebssicheren Zustand,
9.1.5. die Verwendung des Fahrzeugs nur zum vertragsgemäßen Gebrauch, sowie
9.1.6. das ordnungsgemäße Verschließen des Fahrzeugs.
9.2. Das Fahrzeug darf im Rahmen der vertragsgemäßen Nutzung nicht verwendet werden: Für Fahrzeugtests oder Fahrsicherheitstrainings, zur gewerblichen Personen- oder Güterbeförderung, zu motorsportlichen Zwecken sowie den dazugehörigen Übungsfahrten, zur Teilnahme an Wettbewerben oder illegalen Wettrennen, zur ent- oder unentgeltlichen Vermietung einschließlich Carsharing, zu journalistischen Zwecken (Veröffentlichen von Testberichten und Erfahrungsberichten gegenüber der Presse oder Veröffentlichungen im Internet, z.B. Social-Media), zur Begehung von Straftaten (auch wenn diese nur nach dem Recht des Tatorts mit Strafe bedroht sind), zur Beförderung von leicht entzündlichen, giftigen oder sonst gefährlichen Stoffen, für das Schieben oder Abschleppen eines anderes Fahrzeugs, an Orten, die nicht für den öffentlichen Verkehr zugelassen sind, wie z. B. Strände, Rennstrecken, etc.
9.3. Die vertragsgemäße Nutzung verbietet darüber hinaus,
9.3.1. das Rauchen im Fahrzeug (bei Zuwiderhandlungen wird dem Mieter eine Reinigungspauschale von mindestens EUR 200,00 berechnet),
9.3.2. jegliche technischen oder optischen Veränderungen weder am Äußeren noch im Inneren des Fahrzeugs (z.B. das Anbringen von Aufkleber, Umbauten oder Fahrzeug-Tuning) ohne die vorherige Zustimmung des Vermieters. Sollte nach Rückgabe des Fahrzeugs dennoch eine Veränderung entsprechend dem Vorgenannten festgestellt werden können, werden dem Mieter die Kosten für die Wiederherstellung des Originalzustands in Rechnung gestellt. Die Geltendmachung eines weitergehenden Schadensersatzes bleibt ausdrücklich vorbehalten. Sowie
9.3.3. das Führen bzw. die Nutzung des Fahrzeugs außerhalb des zulässigen Gebiets entsprechend Ziff. 10. Das Risiko, dass die Kfz-Versicherung entsprechend Ziff. 12. den Ersatz von etwaigen Schäden am Fahrzeug außerhalb Deutschlands nicht umfasst, trägt dabei der Mieter vollumfänglich.
9.4. Bei Glatteis, Schneeglätte, Schneematsch, Eis- oder Reifglätte darf das Fahrzeug nur mit für diese Witterung geeigneten Reifen gefahren werden. Sollten über Winterreifen hinaus zusätzliche Sicherungsmaßnahmen wie Schneeketten oder ähnliches erforderlich sein, wird der Mieter diese entsprechend bereitstellen und nutzen.
9.5. Im Falle eines Verstoßes gegen die vorstehende Verpflichtung aus Ziff. 9.1.1 hat der Mieter eine pauschale Zusatzgebühr für jeden weiteren nicht autorisierten Fahrer zu zahlen.
9.6. Der Mieter haftet entsprechend den gesetzlichen Regelung in vollem Umfang für Schäden, die an den inneren und äußeren Teilen des Fahrzeugs durch die entsprechend dieser Ziff. 9. nicht vertragsgemäße Nutzung des Fahrzeugs verursacht werden.
10. Zulässiges Gebiet, Fahrten in das EU-Ausland (Grenzübertritt)
10.1. Das Fahrzeug darf neben Deutschland nur in den Ländern der Europäischen Union mit Ausnahme von Bulgarien und Rumänien (nachfolgend: „EU-Ausland“) gefahren werden. Dies sind derzeit: Belgien, Dänemark, Deutschland, Estland, Finnland, Frankreich, Griechenland, Irland, Italien, Kroatien, Lettland, Litauen, Luxemburg, Malta, Niederlande, Österreich, Polen, Portugal, Rumänien, Schweden, Slowakei, Slowenien, Spanien, Tschechien, Ungarn, Zypern. Das Führen des Fahrzeugs in anderen Ländern ist strengstens untersagt.
10.2. In Falle eines beabsichtigten Grenzübertritts in das EU-Ausland ist der Mieter verpflichtet, den Vermieter vorab hierüber zu informieren. Er ist bei einer Fahrt in das EU-Ausland verpflichtet, alle hierfür erforderlichen Fahrzeugdokumente und Sicherheitszubehör mitzuführen.
10.3. Für einen Grenzübertritt in das EU-Ausland fällt zudem der INTERNATIONAL (INT) Aufschlag an, welche eine Zusatzversicherung darstellt, nach welcher die Passagiere sowie das Fahrzeug auch im Falle eines Grenzübertritts versichert sind (soweit das Fahrzeug auch im EU-Ausland vertragsgemäß genutzt wird entsprechend Ziff. 9.). Die Kosten für diesen Service sind im beigefügten Anhang aufgeführt.
10.4. Das Fahrzeug darf bei einer Fahrt in das EU-Ausland weder verschifft noch auf irgendeinem Transportmittel befördert werden, außer wenn dies zuvor ausdrücklich und in Textform vom Vermieter genehmigt wurde.
10.5. Einige der Fahrzeuge des Vermieters verfügen über ein Ortungssystem. Das Überschreiten des zulässigen Gebiets stellt dabei einen Verstoß gegen die vertragsgemäße Nutzung nach Ziff. 4.3. c) dar.
11. Fahrzeug-Identifizierung
Der Mieter ist verpflichtet, die Aufkleber und Kennzeichenhalter von OK RENT A CAR am Fahrzeug zu belassen, damit dieses als Mietfahrzeug des Vermieters identifiziert werden kann. Bei Entfernung der vorgenannten Aufkleber oder Kennzeichenhalter wird eine pauschale Gebühr für die Wiederanbringung derselben pro Aufkleber/Kennzeichenhalter zuzüglich eines aufgrund deren Entfernung dem Vermieter hierfür möglicherweise auferlegten verwaltungsrechtlichen Bußgelds berechnet.
12. Versicherungsarten
12.1. Haftplicht- und Vollkaskoversicherung
12.1.1. Der Basismietpreis aller Fahrzeuge (vgl. Ziff. 4.1.) umfasst die sog. CDW-Grundversicherung, welche die nach den Vorgaben des Pflichtversicherungsgesetzes obligatorische Haftpflichtversicherung mit einer Deckungssumme von bis zu EUR 50.000.000,00 pro Einzelfall sowie eine Rechtsschutzversicherung und eine Vollkasko-Versicherung mit Selbstbeteiligung entsprechend der Fahrzeugkategorie des Fahrzeugs umfasst. Für die Vollkasko-Versicherung gelten grundsätzlich die Allgemeinen Bedingungen für die Kfz-Versicherung (AKB) des Versicherers, die dem Mieter auf Wunsch zur Verfügung gestellt werden, sofern nachfolgend keine abweichenden Regelungen getroffen werden.
12.1.2. Die Vollkasko-Versicherung sowie deren Selbstbeteiligung ist in vier Gruppen/Segmente entsprechend den Fahrzeugkategorien unterteilt und im Mietvertrag des Fahrzeugs hinterlegt: Die Fahrzeuggruppen so wie die Beträge der Selbstbeteiligung sind im beigefügten Anhang aufgeführt.
12.1.3. Sofern die optionale Zusatzversicherung OK PREMIUM COVER (Ziff. 12.2.3.) vom Mieter nicht abgeschlossen wird, wird nach Vorabautorisierung des Mieters gegenüber dem Vermieter der entsprechende Betrag der Selbstbeteiligung zwischen EUR 900,00 und 4.000,00, je nach Gruppe/Segment des Fahrzeugs, auf der Kreditkarte des Mieters für die Mietdauer blockiert. Diese Versicherungskaution dient der Sicherstellung sämtlicher Ansprüche des Vermieters gegenüber dem Mieter aufgrund von Schäden oder Mängel des Fahrzeugs. Der Betrag der Versicherungskaution wird nur dann entsprechend Ziff. 4.4. von der Kreditkarte des Mieters abgebucht, sollte der Mieter seine Pflichten gegenüber dem Vermieter nicht erfüllen. Andernfalls wird der geblockte Betrag wieder entsprechend freigegeben. Ziff. 4.4. gilt im Übrigen entsprechend.
12.1.4. Bei einem Schadensfall ist der Mieter berechtigt, die Vollkaskoversicherung (z.B. bei eigenverschuldetem Unfallschaden, Vandalismus, Parkrempler), die Vollkaskoversicherung (z.B. bei Steinschlag oder Glasbruch) und die Haftpflichtversicherung (z.B. Beschädigung eines Fremdfahrzeugs) in Anspruch zu nehmen. Sollte die Schadenshöhe bei einem Versicherungsfall den Selbstbeteiligungsbetrag unterschreiten, trägt der Mieter allerdings die unmittelbar anfallenden Reparaturkosten. Hinsichtlich der Abwicklung eines Schadensfalls wird auf Ziff. 13. verwiesen.
12.2. Zusatzversicherungen Alle nachfolgenden Zusatzversicherungen können gegen einen zusätzlichen Aufpreis auf die unter Ziff. 12.1. genannte Haftpflicht- und Vollkaskoversicherung (nachfolgend: „Aufpreis“) bei Abschluss des Mietvertrages zusätzlich auf Wunsch vom Mieter gebucht werden.
12.2.1. Räder und Scheinwerfer (CGT): Durch Abschluss dieser Zusatzversicherung werden mögliche Schäden an Scheinwerfern und Rädern, die besonders unvorhersehbar und welche generell anfällig für Schäden sind, abgedeckt. Eine Übernahme von Schäden durch nicht vertragsgemäße Nutzung des Fahrzeugs entsprechend Ziff. 9. ist ausgeschlossen. Die Kosten für diesen Service sind im beigefügten Anhang aufgeführt.
12.2.2. Pannendienst PREMIUM (CAR): Diese Zusatzversicherung umfasst im Falle einer Panne des Fahrzeugs im Inland einen Telefonservice rund um die Uhr unter der Telefonnummer +49 (0)8912231546, den Austausch bzw. Ersatz des von einer Panne betroffenen Fahrzeugs, die Pannenhilfe auf der Straße mit einem Abschleppdienst, welcher so schnell wie möglich am Pannenort erscheint. Diese Zusatzversicherung kommt nicht zur Anwendung, wenn die Panne auf Fahrlässigkeit des Mieters, einem Unfall oder einer Stilllegung des Fahrzeugs infolge von mit dem Fahrzeug ausgeführten Straftaten oder Ordnungswidrigkeiten zurückzuführen ist. Die Kosten für diesen Service sind im beigefügten Anhang aufgeführt.
12.2.3. OK PREMIUM COVER: Diese Zusatzversicherung umfasst neben den Zusatzversicherungen Räder und Scheinwerfer nach Ziff. 12.2.1, einen Wegfall der Selbstbeteiligung sowie der Abwicklungsgebühr im Falle eines Schadens nach Ziff. 12.1. Der Aufpreis für diese Zusatzversicherung richtet sich der Gruppe/Segment entsprechend der Kategorie des Fahrzeugs, welche im Mietvertrag hinterlegt ist. Die Kosten für diesen Service sind im beigefügten Anhang aufgeführt.
12.3. Allgemeine Ausschlüsse bei den Versicherungen, Versicherungsausfall
12.3.1. Die unter Ziff. 12.1. und 12.2. genannten (Zusatz-)Versicherungen erfassen dabei nicht nachfolgende Schäden am Fahrzeug: Konstruktionselemente, Unterboden, Ausstattung innen und außen. Diese Auflistung dient nur Informationszwecken, der konkrete Umfang der abgedeckten sowie ausgeschlossenen Schäden ergibt sich aus der „Tabelle der Preise für Schäden, Diebstahl und/oder Verlust des Fahrzeugs und damit verbundene Dienstleistungen", in welcher detailliert alle möglichen Schäden, Diebstahl und/oder Verlust des Fahrzeugs und damit verbundene Dienstleistungen neben den jeweiligen Preisen aufgeführt sind und welche in den Mietwagenstationen des Vermieters ausliegt sowie auf der Website des Vermieters unter https://okrentacar.es/de/ abrufbar ist oder in sonstigen, vom Vermieter für angemessen erachteten öffentlich zugänglichen Medien veröffentlicht wird, über die der Mieter bei Abschluss des Mietvertrages informiert wird. Alle Preise werden dort in Euro (EUR) angegeben und beziehen sich auf mögliche Schäden, Verluste und Dienstleistungen, welche entsprechend auch dem Mieter in Rechnung gestellt werden.
12.3.2. Darüber hinaus erfassen die unter Ziff. 12.1. und 12.2. genannten (Zusatz-)Versicherungen keine Schäden am Fahrzeug, die sich auf die folgenden Sachverhalte/Elementarereignisse zurückführen lassen: Krieg, Naturkatastrophen und -ereignisse (z.B. Hagelschlag, Schneetreiben), Terrorismus, Aufruhr oder Meuterei, Einsätze der Sicherheitsbehörden und -kräfte des Staates, Unfall oder Sicherstellung des Fahrzeuges aufgrund von Straftaten oder Verstößen, in denen das Fahrzeug involviert ist. In diesen Fällen haftet der Mieter nach den gesetzlichen Vorschriften. Zudem ist der Verlust oder Diebstahl von persönlichen Gegenständen, die im Fahrzeug zurückgelassen, aufbewahrt oder transportiert werden, ebenfalls nicht vom Versicherungsumfang gedeckt.
12.3.3. Bei Versicherungsausfall, das heißt Schäden und Mängeln am Fahrzeug, die der Mieter oder Fahrer vorsätzlich herbeiführt, besteht kein Versicherungsschutz. Bei grob fahrlässig herbeigeführten Mängeln und Schäden wird die Versicherungsleistung in einem der Schwere des Verschuldens entsprechenden Verhältnis gekürzt. Ergänzend gelten die AKB des Versicherers.
13. Schäden oder Mängel am Fahrzeug während der Mietdauer
13.1. Mängel oder Schäden am Fahrzeug hat der Mieter dem Vermieter unverzüglich in Textform anzuzeigen. Bei Schäden oder Mängeln, die durch Unfälle mit Dritten, kriminelle Handlungen oder Vandalismus Dritter (vgl. Ziff. 14.) am Fahrzeug entstehen, ist der Mieter zu nachfolgenden schadensmindernden und beweissichernden Handlungen verpflichtet:
13.1.1. Der Polizei den Vorfall umgehend zu melden;
13.1.2. das offizielle Unfallberichtsformular, das sich im Fahrzeug befindet, auszufüllen. Dabei ist zumindest das Kfz-Kennzeichen, der Name und die Adresse des Dritten sowie deren Versicherungsgesellschaft und, wenn möglich, die Nummer der Versicherungspolice anzugeben;
13.1.3. kurz den Unfallhergang zu beschreiben und ggf. den Namen von Zeugen anzugeben;
13.1.4. nicht vorab ein Schuldanerkenntnis vom Mieter oder den Fahrern abzugeben;
13.1.5. keinerlei Angaben zur Sache gegenüber Versicherern anderer Unfallbeteiligten zu machen ohne dies vorher mit dem Vermieter abzuklären.
13.1.6. das Fahrzeug nicht zu verlassen, ohne geeignete Maßnahmen zur Sicherung des Fahrzeugs vor weiteren Schäden zu ergreifen. Das Fahrzeug sollte dementsprechend nur verschlossen zurückgelassen werden und andere Verkehrsteilnehmer nicht beeinträchtigten; sowie
13.1.7. den Vermieter unverzüglich telefonisch unter der Telefonnummer +49 (0)8912231546 über den Vorfall zu informieren.
13.1.8. Des Weiteren muss der Mieter auch im Nachgang umfassend zur Aufklärung des Schadensereignisses beitragen, dies betrifft insbesondere die Beantwortung von Rückfragen zum Schadenshergang. Wenn der Mieter einen dieser Punkte vorsätzlich oder fahrlässig verletzt und daraus kein Versicherungsschutz entsteht, gilt Ziff. 12.3.3. entsprechend.
13.3. Sollte das Fahrzeug aus Gründen, die der Vermieter nicht zu vertreten hat, vorübergehend oder dauerhaft nicht nutzbar sein, hat der Mieter keinerlei Ansprüche gegen den Vermieter auf Nutzungsentschädigung und/oder Ersatz von Mietwagenkosten, sofern diese nicht von der Kfz-Versicherung übernommen werden. Dies betrifft insbesondere die vorsätzliche Zerstörung des Fahrzeugs durch den Mieter. Der Vermieter kann den Mieter dennoch nach freiem Ermessen ein neues Mietfahrzeug unter den bisherigen Konditionen des Mietvertrages anbieten, um das beschädigte Fahrzeug auszutauschen.
13.4. Jegliche versicherungstechnischen Abwicklungen erfolgen über den Vermieter.
13.5. Bei Bedarf kann der Vermieter einen spezialisierten Anwalt zur Schadensregulierung beauftragen. Die Kosten für die Rechtsverfolgung werden dem Mieter gemäß seinem Verschulden nur in Rechnung gestellt, soweit ein Versicherungsausfall oder eine Leistungskürzung nach Ziff. 12.3.3. vorliegt.
13.6. Für die Bearbeitung Für die Bearbeitung eines Schadensfalls durch den Vermieter wird dem Mieter zusätzlich pro Einzelfall eine Pauschale unabhängig von der konkreten Höhe des Schadens in Rechnung gestellt. Dem Mieter wird der Nachweis gestattet, dass ein niedrigerer Schaden als die Pauschale oder gar kein Schaden entstanden ist.
13.7. Sofern entsprechende Reparatur/Instandsetzung des Fahrzeugs aufgrund von Mängeln oder Schäden erforderlich ist erfolgt eine Koordination durch den Vermieter. Reparaturen in einer Werkstatt oder der Austausch von Ersatzteilen dürfen nur nach vorheriger, ausdrücklicher und Genehmigung des Vermieters zumindest in Textform vorgenommen werden. Hierbei muss dem Vermieter auch ein Kostenvoranschlag der ausführenden Werkstatt vorgelegt werden. Reparaturkosten werden nicht zurückerstattet, sofern nicht die vorherige Zustimmung des Vermieters zum Kostenvoranschlag und zu der die Reparatur ausführenden Werkstatt vorliegt. Andernfalls ist allein der Mieter zur Zahlung dieser Kosten für Werkstatt und Ersatzteile verpflichtet.
13.7. Alle während der Mietdauer anfallenden Kosten aufgrund von notwendigen Inspektions-, Wartungs- und Verschleißarbeiten gemäß den Serviceintervallen des Herstellers („Scheckheft“) werden ebenfalls vom Vermieter übernommen und sind mit dem Mietpreis abgegolten. Der Mieter erklärt sich ausdrücklich damit einverstanden, dass auch während der Mietdauer derartige Inspektions-, Wartungs- oder Verschleißarbeiten, sofern nötig, durchgeführt werden können. In diesem Zusammenhang ist der Mieter auch verpflichtet, dem Vermieter alle Anzeigen für notwendige Wartungs- und Verschleißarbeiten (z.B. Kontrollleuchte Service oder Ölwechsel) unverzüglich mitzuteilen.
14. Beispiele für kriminelle Handlungen oder Vandalismus
14.1. Entwendung des Fahrzeugs oder Entwendung bzw. Beschädigung von Außen- bzw. Innenteilen des Fahrzeugs, wie Rädern, Reifen oder Autositze durch Diebstahl oder Raub.
14.2. Vandalismus am Fahrzeug und damit einhergehend beispielweise Beschädigung der Scheiben oder der Karosserie des Fahrzeuges.
14.3. Die vorstehende Auflistung ist beispielhaft, aber nicht vollständig.
15. Verkehrsverstöße
15.1. Der Mieter haftet bei Verkehrsverstößen (im In- und Ausland) während der Mietdauer im vollem Umfang für alle Inanspruchnahmen und Kosten (insb. Verwarnungs- und Bußgeldern, Fahrtenbuchauflagen nach § 31 a StVZO, Sicherstellung des Fahrzeugs), davon umfasst sind auch Vergehen von anderen Fahrern.
15.2. Dem Mieter werden alle im Rahmen eines Verkehrsverstoßes etwaige dem Vermieter zugesandte Unterlagen der zuständigen Behörden weitergeleitet, dies betrifft insbesondere einen etwaigen Anhörungsbogen zum Verkehrsverstoß. Der Mieter ist verpflichtet, dafür Sorge zu tragen, dass eine entsprechende Rückmeldung in diesen Fällen an die zuständige Behörde fristgerecht erfolgt.
15.3. Für die Bearbeitung der Verkehrsverstöße durch den Vermieter wird dem Mieter zusätzlich pro Einzelfall eine Pauschale in Rechnung gestellt. Dem Mieter wird der Nachweis gestattet, dass ein niedrigerer Schaden als die Pauschale oder gar kein Schaden entstanden ist.
16. Haftung
Der Vermieter haftet nicht für sich, seine Vertreter oder Erfüllungsgehilfen, es sei denn, dass er
16.1. vorsätzlich oder fahrlässig Leben, Körper oder Gesundheit einer anderen Person verletzt hat,
16.2. vorsätzlich oder fahrlässig wesentliche Vertragspflichten (Kardinalspflichten) verletzt hat. Wesentliche Vertragspflichten sind solche, deren Erfüllung zur Erreichung des Ziels des jeweiligen Vertrages notwendig sind und die daneben wesentlichen Rechtspositionen aus dem jeweiligen Vertrag, wie insbesondere Ziff. 9., schützen. Bei der Verletzung wesentlicher Vertragspflichten haftet der Vermieter nur auf den vertragstypisch, vorhersehbaren Schaden, wenn dieser leicht fahrlässig verursacht wurde, es sei denn, es handelt sich um eine Verletzung des Lebens, des Körpers oder der Gesundheit,
16.3. vorsätzlich oder grob fahrlässig nicht wesentliche Vertragspflichten verletzt hat. Außerdem haftet der Vermieter, soweit zwingende gesetzliche Haftungsregelungen bestehen.
17. Mietdauer und Verlängerung, Kündigung des Mietvertrages
17.1. Mietdauer und Verlängerung
17.1.1. Die Mietdauer wird im Mietvertrag definiert und beginnt am Übergabetermin. Die Mindest-Mietdauer beträgt einen Tag, wobei die Berechnung der Tage der Mietdauer nach 24-Stunden-Zeiträumen erfolgt (nachfolgend: „Miettag“). Diese darf nicht unterschritten werden. Die Mietdauer endet ohne gesonderte Kündigung vorbehaltlich Ziff. 17.1.2. automatisch am letzten Tag der vertraglichen vereinbarten Mietdauer. Setzt der Mieter den Gebrauch des Fahrzeugs nach Ablauf der vereinbarten Mietdauer fort, so gilt das Mietverhältnis nicht automatisch als verlängert. § 545 BGB findet keine Anwendung.
17.1.2. Wenn der Mieter die im Mietvertrag vereinbarte Mietdauer verlängern möchte, muss der Mieter persönlich in der Mietwagenstation des Vermieters, in der Mietvertrag ausgefertigt wurde, oder in jeder anderen Mietwagenstation des Vermieters unter den Bedingungen von Ziff. 8.2.2. dieser AVB vor Ablauf der vertraglich vereinbarten Mietdauer erscheinen und eine entsprechende Verlängerung der Mietdauer schriftlich beantragen. Die Mietdauer muss um mindestens einen Miettag verlängert werden. Der Vermieter behält sich das Recht vor, den Antrag auf Verlängerung der Mietdauer aufgrund operativer Gründe, insbesondere aufgrund bereits erfolgter Weitervermietung des Fahrzeugs, abzulehnen. Verlängerungen der Mietdauer sind gesondert zu vergüten und nicht im ursprünglichen Mietpreis enthalten (nachfolgend: „Verlängerungsmietpreis“). Die Berechnung des Verlängerungsmietpreises richtet sich nach den Bestimmungen zur Berechnung des bisherigen Mietpreises. Dieser ist neben einer ergänzend anfallenden Kaution für die verlängerte Mietdauer, welche sich ebenfalls nach den bisherigen Bestimmungen zur Berechnung der Kaution richtet, sofort bei Verlängerung der Mietdauer zu entrichten.
17.2. Kündigung
17.2.1. Die ordentliche Kündigung ist während der Mietdauer ausgeschlossen.
17.2.2. Das Recht zur außerordentlichen fristlosen Kündigung aus wichtigem Grund bleibt hiervon unberührt. Ein zur außerordentlichen Kündigung berechtigender Grund für den Vermieter liegt insbesondere vor, wenn
a) der Mieter oder der Fahrer das Fahrzeug entgegen der vorgeschriebenen vertragsgemäßen Nutzung entsprechend Ziff. 9. verwendet,
b) der Mieter oder Fahrer das Fahrzeug einem unbefugtem Dritten überlässt (siehe Ziff. 3.1.),
c) sich die Vermögensverhältnisse des Mieters wesentlich verschlechtern,
d) gegen den Mieter Zwangsvollstreckungsmaßnahmen eingeleitet wurden,
e) die Fortsetzung des Mietvertrages unzumutbar ist, z.B. wegen zu hoher Schadensquote des Mieters,
f) dem Mieter sein Führerschein durch Verwaltungsakt entzogen wird und
g) der Mieter wiederholt, d.h. mehr als zwei Mal, das Fahrzeug entgegen Ziff. 3.3. in fahruntüchtigem Zustand geführt hat.
17.2.3. Die Kündigung sowie die Beendigung der Mietdauer hat insbesondere zur Folge, dass
a) der Mieter das Besitzrecht am überlassenen Fahrzeug verliert und
b) der Mieter zur Herausgabe des Fahrzeugs im Rahmen der in Ziff. 8.2. vorgegebenen Voraussetzungen verpflichtet wird. Ein Zurückbehaltungsrecht am Fahrzeug steht dem Mieter nicht zu.
17.2.4. Nach erfolglosem Ablauf einer angemessenen Herausgabefrist betreffend die Gegenstände und Unterlagen nach Ziff. 17.2.3. b) ist der Vermieter berechtigt,
a) dass Fahrzeug in Besitz zu nehmen,
b) dem Mieter die Kosten für die Lokalisierung und Sicherstellung des Fahrzeugs und der Ersatzbeschaffung der Fahrzeugschlüssel und Fahrzeugdokumente, sowie die Kosten weiterer hierdurch entstandener Schäden ersetzt zu verlangen. Der Vermieter ist dazu nicht berechtigt, wenn der Mieter die verspätete Herausgabe nicht zu vertreten hat. Das Handeln der Fahrer wird dem Mieter dabei wie eigenes Verschulden zugerechnet.
17.2.5. Im Falle der außerordentlichen Kündigung bleibt die Geltendmachung von weiteren Schadensersatzansprüchen seitens des Vermieters ausdrücklich vorbehalten.
17.2.6. Jede Kündigung muss in Textform erfolgen.
18. Steuern
Alle Preise beinhalten, sofern nicht ausdrücklich anders zwischen Vermieter und Mieter vereinbart, die jeweils derzeit gültige Umsatzsteuer.
19. Gerichtsstand und anwendbares Recht, Verbraucherstreitbeilegung
19.1. Gerichtsstand ist, soweit gesetzlich zulässig, insbesondere sofern der Mieter Kaufmann ist, München.
19.2. Die Geschäftsbeziehungen zwischen dem Vermieter und dem Mieter unterliegen dem Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
19.3. Die EU-Kommission stellt eine Plattform für die außergerichtliche Online-Streitbeilegung (OS-Plattform) bereit, die unter https://ec.europa.eu/consumers/odr aufrufbar ist. Wir sind darüber hinaus weder bereit noch verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
20. Übersetzung
Der Mieter kann die vorliegenden AVB auf Wunsch auch in anderen Sprachen erhalten. Versionen dieser AVB in anderen Sprachen werden als Übersetzung gekennzeichnet. Der Mieter wird in den Mietwagenstationen auf Rückfrage darüber informiert, in welchen Sprachen die AVB erhältlich sind. Im Falle von Unterschieden ist allein die deutsche Version maßgeblich.
21. Schlussbestimmungen
Sollten gegenwärtige oder zukünftige Bestimmungen der AVB ganz oder teilweise nicht rechtswirksam sein oder ihre Rechtswirksamkeit oder Durchführbarkeit später verlieren, so wird hierdurch die Gültigkeit der übrigen Bestimmungen dieser AVB nicht berührt.

The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between MONZA SA commercial company which offers car rental services under the brand “OK MOBILITY” (Car Rental Division) as official franchisee in the territory of Greece (hereinafter, “Rental Company” or “Lessor”) and the paying customer (hereinafter, “Renter” or “Lessee”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement.In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage cause, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged a Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of the Rental Company where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. The Rental Company allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost for One Way between the islands. If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the vehicle 2.1. Extension of the Agreement: The Renter must give express written notice, attending the Rental Company’s office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. Should the Renter want to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of the Rental Company or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (7:00 to 22:00) carries a compulsory extra charge. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox that will be indicated to the Lessee at the CheckOut or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 19 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver).4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of RENTAL COMPANY on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration plus payment of the possible administrative penalty imposed as a result thereof. Any documents or notices which are affixed in the Vehicle in a visible spot by the Rental Company must not be removed for any reason, if this obligation is not fulfilled, a penalty may be incurred by the Lessee and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the Vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to RENTAL COMPANY, Gran Vía Asima,36,A,- 07009,Palma, Balearic Islands, Spain. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of RENTAL COMPANY or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. The categories are differentiated in three Groups/ Segments (specifying them in the specific conditions of the Agreement). In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between € 900 and € 4000, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, the administration fee of damages will be charged, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. The cost for this service is detailed in the attached Annex. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +30 6 937 337 200 Heraklion station, +30 6 943 470 525 Rhodes station, +30 6 932 619 529 Chania Station, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. The cost for this service is detailed in the attached Annex. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, PREMIUM (CAR), Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, differentiating between the different Groups/Segments established in the Annex.Young Driver, from 19 to 25 years of age. The cost for this service is detailed in the attached Annex. - Second driver: An optional extra so that a second person can drive the vehicle. The cost for this service is detailed in the attached Annex. Third driver: An optional extra so that a third person can drive the vehicle. The cost for this service is detailed in the attached Annex.9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of RENTAL COMPANY or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards RENTAL COMPANY, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from RENTAL COMPANY , according to the chart per GROUP 1/GROUP 2/ GROUP 3/ GROUP 4.10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform RENTAL COMPANY of the accident by calling the emergency telephone number: +30 6 937 337 200 Heraklion station, +30 6 943 470 525 Rhodes station, +30 6 932 619 529 Chania Station. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use.It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract and must pay a charge for unauthorized use of the vehicle for this reasonand the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g. using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge a fee to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the refueling management costs.a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory: The vehicle may only be driven in the national territory of Malta and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. In the event of cross-border crossing, the Lessee must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our Vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. The cost for this service is detailed in the attached Annex. 17. Mileage: On the Greek Islands: unlimited per lease period. All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, an additional charge for exceeded mileage will be charged. 18. Additional services and extras:Speedy Check In: this is the fast delivery service of the Vehicle and each service has a separate cost. The cost for this service is detailed in the attached Annex. 18.1. Extras: The Lessor offers child and baby seats under the cost established in the Annex. GPS: The lessor offers GPS under the cost established in the Annex. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash in our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. RENTAL COMPANY only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Courts of Greece for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected] , indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours (Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 24. Customer service and claims: If you want to make any suggestions about improvement of our services, you can use the email: [email protected] additionally, all our facilities have official complaint sheets which will be given to you when requested to our employees. 25. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and the Rental Company. 26. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the English version. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS.INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with Regulation 2016/679 (the General Data Protection Regulation - GDPR), you are informed that the personal data here gathered will be included in filing systems of which the data controller is MONZA SA. The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS.- If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. I expressly agree that the data contained in the Contract may be transferred to keep me informed either by email or by any other means as to operational and commercial information and the execution of opinion studies as to products and services offered by MONZA SA, or entities in the same sector with which it collaborates, in connection with the leisure, insurance, financial and automotive sectors. Further details as to our privacy policy may be consulted on our website. RIGHTS OF THE INTERESTED PARTY. The present GENERAL CONDITIONS OF CONTRACT OF VEHICLE RENTAL (hereinafter, “General Conditions”) shall regulate the contractual relationship between ZING RENTAL LIMITED commercial company which offers car rental services under the brand “OK MOBILITY” (Car Rental Division) as official franchisee in the territory of Malta (hereinafter, “Rental Company” or “Lessor”) and the paying customer (hereinafter, “Renter” or “Lessee”), by virtue of which the first assigns to the second the use of a vehicle (hereinafter, “Vehicle”) for the period, price and other conditions stipulated by the parties in the rental agreement (hereinafter, “Agreement”), which shall be executed and signed in the facilities of the Rental Company. If there is a discrepancy between the content of any point in the General Conditions and those signed between the parties, the latter will prevail. It is the responsibility of the Renter to keep a copy of this agreement at all times in the Vehicle and at sight. 1. Object of the Agreement: It is the rental without driver of the Vehicle described in the specific conditions of the Agreement for the private transport of passengers and their luggage, fulfilling all the General Conditions established in this document. 2. Rental period, Check-Out, Check-In and extension: The minimum rental period shall be 1 day (24 hours) and the maximum shall be determined according to the Agreement. The rental days shall be calculated for 24-hours granting a grace period of 60 minutes from the date and time of the Vehicle Check-In stated in the Agreement.In the event that the aforementioned period is not fulfilled, the Lessor will be authorised to collect the rental amount from conclusion of the contract until the Vehicle is returned, according to the Valid General Rate established in the Price Table attached to the contract, the mileage, damage and a penalty for economic damage caused which will amount to €45 due to delay, and this amount will be added each day, from the date the Check-In had been made on, until return or recovery and preparation of the Vehicle. If the Lessee abandons the Vehicle, in addition to the foregoing, they will be charged €250 for the Vehicle recovery fee, plus all of the expenses and costs arising from its recovery. Performing the Check-In prior to the end of the period shall not entail the return or refund of the price given in the Contract, as it is considered a unilateral termination of the contract by the Lessee. If the Lessee breaches any of the points established in the General or Special Conditions established in the Contract, the Lessor reserves the right to take the Vehicle from the Lessee at any time, and the Lessor may seek damages. For operational motives of inspection of the Vehicle, the Rental Company reserves the right to replace the Vehicle at any time for another of similar characteristics previously informing the Renter. The Check-Out and the Check-In shall be performed in the facilities of the Rental Company where the Agreement was signed, in the periods and terms stipulated in the specific conditions of the Agreement. The Rental Company allows the Vehicle Check-In to be carried out by the Lessee in company facilities different from those where the Contract was signed (One Way fee), in accordance with the conditions and restrictions of the service itself, as indicated on our website and those set out in point 16, in the same periods and terms stipulated in the specific conditions of the contract, and the Lessee must bear the cost: €300 for installations located in different islands where the Vehicle was rented. If the Lessee does not perform the Check-In or abandons the Vehicle, the Lessee will be charged the excess cost of the Vehicle recovery fee plus all of the expenses and costs arising from the recovery, together with the rental days owed, according to the Valid General Rate established on the website or at the Lessor's facilities for the period between Check-In, as established in the Contract, until the effective recovery and preparation of the vehicle 2.1. Extension of the Agreement: The Renter must give express written notice, attending the Rental Company’s office where the Agreement was signed at any time before the end of the rental period established in the Agreement. The minimum extension period shall be at least 1 day (24 hours) and can be extended according to the specific conditions of the Agreement. In no case can the price at the start of the Agreement serve as its extension. Should the Renter want to keep the Vehicle for a time greater than that initially agreed, he/she undertakes to previously obtain express authorisation from the Rental Company and immediately pay the amount of the additional deposit for said extension. The price applicable to the extension period of the rental shall be that indicated in the Current General Rate, established in the website or facilities of the Rental Company or other means that the Rental Company considers. The Rental Company reserves the right to refuse the request for extensions for operational reasons. Use of the Vehicle, once the lease period is concluded or it is extended will be understood as unauthorised use for the purposes of point 12 of this contract, and it will be reported as misappropriation. The delivery or return of the Vehicle outside of the office’s trading hours (8:00 to 23:00) carries a compulsory extra charge of €50 per service. If the return or Check-In is carried out in an office located in an airport, the Vehicle’s key should be placed in the postbox number 21 that will be indicated to the Lessee at the CheckOut or delivery of the Vehicle. 3. Driver(s): The Lessee and the additional drivers must be at least 21 years of age and must have had their driver's licence for a minimum of one year and are required to present a European national identification document or passport, both valid, legible and in good condition. Point 9.1 sets forth the covers for Young Drivers (from 19 to 25 years of age, both included) and additional drivers (second driver and third driver).4. Vehicle maintenance: The Lessee receives the Vehicle in perfect condition and must maintain it in good repair and may not make any modifications to the exterior or the interior. If any modification is made, its restoration plus any possible damage will be charged to the Lessee. Repairs at the garage or replacement of parts may only be made subsequent express written authorisation from the Lessor. No repair expenses will be reimbursed without the prior consent and approval of the Lessor of the estimate and the garage which makes the repair. In the event that such express written consent has not been granted, payment of said expenses, both for the garage and the replacement parts, will be the exclusive responsibility of the Lessee. 5. Vehicle Identification: The Lessee must keep the identifying stickers and registration holders of RENTAL COMPANY on the Vehicle leased in order that it may be identified. Removal of these elements will entail a surcharge for their restoration of €50, for each one, plus payment of the possible administrative penalty imposed as a result thereof. Any documents or notices which are affixed in the Vehicle in a visible spot by the Rental Company must not be removed for any reason, if this obligation is not fulfilled, a penalty may be incurred by the Lessee and the management expenses established in point 13 must be paid. 6. Objects found: The Renter must remove all his/her personal effects from the Vehicle. The Rental Company assumes no liability whatsoever for any objects found in the Vehicle. Notwithstanding the foregoing, all objects found in the vehicle can be sent to the Renter at his/her express request and by writing to RENTAL COMPANY, Gran Vía Asima,36,A,- 07009,Palma, Balearic Islands, Spain. In this case, the Rental Company shall charge a minimum of €20 for sending the objects in addition to the actual shipping costs, which will be fully paid by the Renter. 7. In case of breakdown or accident outside the agreed rental period: Once the contractual relationship has ended between the Renter and the Rental Company (hereinafter, the Parties), the Renter shall be responsible for 100% of the payment of the repairs and costs caused to the Vehicle. 8. Prices and rates: The Contract prices will be adapted to the General Valid Rate displayed for the entire public in the facilities and on the websites of RENTAL COMPANY or by other means determined by the Lessor, the content of which the Lessee expressly states they are aware of prior to this Contract, in particular those related to the type of vehicle and type of contract signed between the Parties. All prices will be indicated and valued in Euros (€). The price of fuel will be detailed when the Contract is signed between the parties. Due to the fluctuation in the prices of fuel, it is impossible to inform the Lessee in these General Conditions of the price thereof. 9. Coverage: The Rental Company offers you different coverages with various rates, specifying the following: All Groups/Segments have: Basic ¡ insurance: it includes basic insurance and civil liability, involving a damages excess, the value of which depends on the category of the vehicle hired. In the event that the additional optional cover OK PREMIUM COVER is not contracted, we will block an amount which will vary between €900 and €2,500, according to the Vehicle Group/Segment, on the Lessee's credit card for pre-authorisation to cover the deductible and any possible damage. If the Lessee returns the Vehicle in the same condition in which it was collected, the amount blocked will be returned. In case of producing new damage, the administration fee of damages will be 60 euros, regardless of the amount established in the "Table of Prices of Damage, Theft and / or Losses and Related Services".9.1. Coverage. Wheel and windscreen (CGT): By taking out this category, the Renter can enjoy the peace-of-mind of knowing that any possible damages to windscreens and wheels, which are the most sensitive and unforeseen due to the very nature of their use, are covered. Their misuse is not covered. This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. PREMIUM (CAR) Roadside assistance: This cover covers 24 hour telephone service, calling the following number: +30 6 937 337 200, the change or replacement of the Vehicle object of the incident, roadside tow truck assistance, arriving at the location of the incident in the shortest time possible (*this cover will not be applied if the aforementioned incident was due to negligence on the part of the Lessee or accident or stoppage of the Vehicle due to crimes or violations committed by the Lessee, specified in points 11 and 12). This cover has a minimum cost of €15; once this minimum has been exceeded €3 per day will be charged until reaching a maximum of €45. (Only in national territory. To receive assistance at the national border crossing, it will be necessary to contract the cross-border crossing (INT) specified in point 16. If this coverage is not contracted, it will be considered a breach of the contract and the Rental Company may charge the Lesser of the damage caused. OK PREMIUM Cover: this coverage category includes Wheel and windscreen, PREMIUM (CAR) Road assistance, Removal of excess, those contained in the "Table of Prices of Damage, Theft and / or Losses and Related Services", in addition to the suppression of the administration fee of damages, Groups/Segments: Group/Segment 1: This coverage has a minimum cost of €45; once this minimum has been exceeded €21 per day will be charged until reaching a maximum of €300, without going over this amount. Premium Groups/Segments 1: This coverage has a minimum cost of €50; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €375, without going over this amount. Group/Segment 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €25 per day will be charged until reaching a maximum of €350, without going over this amount. Premium Groups/Segments 2: This coverage has a minimum cost of €55; once this minimum has been exceeded €30 per day will be charged until reaching a maximum of €450, without going over this amount. Group/Segment 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €35 per day will be charged until reaching a maximum of €490, without going over this amount. Premium Groups/Segments 3: This coverage has a minimum cost of €85; once this minimum has been exceeded €40 per day will be charged until reaching a maximum of €600, without going over this amount.- Young Driver, from 19 to 25 years of age: This coverage has a minimum cost of €24; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €300, without going over this amount. - Second driver: This coverage has a minimum cost of €18; once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €70, without going over this amount. - Third driver: This coverage has a minimum cost of 3€ and a daily cost €1; until reaching a maximum of €30, without going over this amount. 9.2 General exclusions of the coverage and their corresponding surcharges: All of the covers detailed do not include the following services related to damage to the Vehicle, in relation to: Structural elements; undercarriage; interior and exterior equipment. This list is merely for information purposes, due to its length we must refer to the “Table of Prices of Damages and/or Losses and Related Services”, where all possible damages and/or losses and related services, together with their respective prices, are specified in detail. This table is available to the general public in the facilities, websites of RENTAL COMPANY or other means that the Rental Company considers. The Renter expressly states that he/she is aware of its content prior to this Agreement. All prices shall be indicated in euros (€) and shall be used to charge the possible damages, losses and related services in the invoice issued in the name of the Renter. None of the coverage categories shall cover the damages caused in the insured Vehicle as a result of: wars, natural catastrophes and natural phenomena (hailstones, snowstorms or other), terrorism, disturbances or uprisings; acts of the State Security Bodies and Forces, negligence by the Renter, abandonment, accident or immobilisation of the vehicle due to offences or infringements performed therewith and any other activity established in points 11 and 12. These damages and related services shall be at the expense of the Renter. The coverage shall in no case cover personal effects left, stored or transported in the vehicle. SECURITY DEPOSIT/BAIL: Regardless of insurance coverage chosen, an amount will be blocked on your credit card to ensure compliance with your contractual obligations towards RENTAL COMPANY, as well as a guarantee for any possible responsibility aroused during the rental period, the tenant shall be liable for. Such a deposit will be created by means of a blockage on your credit card. Once the rental period expired without incidence, the amount blocked or preauthorized will be released within a maximum period of 30 days. The amount of the deposit or bail will be determined according to the type/category of the vehicle rented from RENTAL COMPANY , according to the chart below: GROUP 1: 150€; GROUP 2: 200€; GROUP 3: 250€. 10. In the case of accident, criminal act or act of vandalism (see point 11) committed against the Vehicle, the Renter is obliged to: a. Immediately report what has happened to the police. b. Complete the accident report using the official model located in the Vehicle, specifying at least the registration number, name and address of the other party and name of the insurer and, where possible, insurance policy number. c. Concisely and accurately described the accident and, where applicable, note down the names of any witnesses. d. Do not prejudge or acknowledge any responsibility for the accident. e. Do not abandon the Vehicle without taking the appropriate measures to protect it from damages, leaving it closed and without disturbing traffic. f. Immediately inform RENTAL COMPANY of the accident by calling the emergency telephone number: +35 6 99217673 Malta Station. In case of accident or crime, the Rental Company shall not be obliged to offer the Renter another rental vehicle. The Rental Company shall receive €60 for handling the processing of the accident report(s). The Rental Company can offer you a new vehicle under the current conditions valid at the indicated time, with the aim of replacing the vehicle object of the accident, criminal act or act of vandalism. In this situation, it shall be considered that the Agreement has concluded between the two parties, Rental Company and Renter, and the Renter must pay all the costs arising from the Agreement to the Rental Company. 11. The following are examples of criminal acts or acts of vandalism against the vehicle: Robbery or theft of the Vehicle. Robbery or theft of external or internal parts of the Vehicle such as wheels, tyres or seats. Burglary causing damages to the windows or bodywork of the Vehicle. Vandalism to the Vehicle. The above list is given merely by way of example and is not intended to be limiting in any way whatsoever.12. Unauthorised use of the Vehicle: The Renter shall be responsible for using the Vehicle with due care, in accordance with its characteristics, respecting valid traffic regulations for motor vehicles in force and, at all times, avoiding all situations that may cause damage to the Vehicle or to third parties. Any case that breaches the stipulations of this paragraph shall also be understood as Unauthorised use.It is the obligation of the Renter not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract and must pay € 60 for this reason and the Renter is directly responsible for any damage or injury caused to the vehicle or to third parties in such case. The Renter shall be fully liable for the damages caused to the interior and exterior of the vehicle due to its unauthorised use. In the event of unauthorised use of the vehicle, the Renter shall be obliged to pay all costs arising due to said damages. This sum specified shall be paid by charging it to the Renter’s credit card, charged to the deposit amount or in cash, with the Renter stating his express consent for all intents and purposes. The Renter’s signature on the Rental agreement shall be considered acceptance of the general and specific conditions stated in this agreement. Unauthorised use includes, but is not restricted to, the following cases given by way of example: • Participation in competitions. •Illegal races • Driving without a driving license or without the authorisation of the Rental Company. • Pushing or towing any other vehicle. • Driving in places not suitable for public transport, such as beaches, racing tracks, etc. • Driving on routes which may cause damages to the vehicle undercarriage/crankshaft. • Negligent use regarding the operation of the pilot lights or warning signals on the vehicle dashboard that the Renter declares to be aware of when signing this agreement. • The transport of goods or animals in the vehicle. • The transport of people or goods that directly or indirectly involves payment to the Renter (e.g. using the vehicle as illegal “taxi”). • The subletting of the vehicle. • The transport of a number of people or quantity of luggage greater than that authorised for the vehicle based on the number of safety belts. • Transport of luggage on top of the vehicle. (It is forbidden to place a roof rack on the vehicle). • Leaving objects in full view inside the vehicle. • Soiling the vehicle’s interior. • Driving the vehicle when tired, ill or under the influence of alcohol, medicine or drugs. • Dangerous driving. • Driving without following traffic regulations. • Driving of the rented vehicle by a person who is not authorised in the agreement either as Renter(s) or additional driver(s). •Driving of the vehicle outside the allowed territory, established in point 16 of these conditions. • Use of the vehicle once the rental period has ended. • Not carrying a baby and/or booster seat if you are travelling with children under the age of 12 or any person with a height lower than 135 cm • IT IS FORBIDDEN TO SMOKE INSIDE THE VEHICLE. 13. Traffic infringements: The Renter shall be liable for payment of the fines of the law during the rental period. The Renter must inform the Rental Company of any fines against the Vehicle or the driver during the rental period. The Rental Company shall always charge €50 to the renter for the notification and handling of fine notifications. Payment of the fines is not included in any of the coverages that can be taken out. Should the authorities detain the Vehicle due to any act or omission by the Renter, for any cause whatsoever, he/she shall be liable and compensate the Rental Company for all expenses and loss of profit incurred for said reason. The administration fee for CVA bills have a cost of 20 €. 14. Joint and several liability. All renters and/or authorised drivers shall be jointly and severally responsible for all the Renter’s obligations arising from this agreement and the laws applicable thereto 15. Fuel policy: At the effective time of the booking and depending on the rate selected by the Renter, once of the following options shall be applied: a) Full/Refund – The Renter shall pay 100% of the tank at Vehicle Check-Out, and the Rental Company shall check the fuel level in the tank in the Vehicle Check-In at that time, refunding the remaining fuel in the tank in accordance with the eight-eighths marker, minus the management costs established at €29. a) Full/Full – At the Check-Out, the Rental Company must hand over the Vehicle tank full. The Renter must also return it full at the Check-In. Should the obligation of filling by the Rental Company not be fulfilled, the Renter can demand at the time of Check-Out that he/she is given the Vehicle with the tank full. If he/she does not complain at that time it shall be understood that he/she is in agreement. If, on the contrary, the Renter should breach this point at the Check-In, he/she shall be charged handling costs of €29 plus the remaining litres until the tank is 100% full. 16. Authorised territory: The vehicle may only be driven in the national territory of Malta and the European Union, except for Bulgaria, Romania, Albania and the United Kingdom. The cross boarding from Malta to Gouzo is permitted with a cost of 40 €. In the event of cross-border crossing, the Lessee must contract (INT) Cross-border crossing supplement in order that passengers and vehicle are covered (as long as normal use is made and not contrary to traffic and circulation rules). This coverage has a minimum cost of €15; once this minimum has been exceeded €10 per day will be charged until reaching a maximum of €150, without going over this amount. The vehicle may not board or be transported on any vessel of transport, unless authentic prior authorisation has been sought, in writing, from the Lessor. Some of our Vehicles are fitted with geolocators and if it is detected that the vehicle has gone beyond the permitted geographical area, it shall be considered a breach of the Contract and the Lessor may charge the Lessee for estimated damages and excess mileage, and this contract shall be terminated immediately for breach of contract on the part of the Lessee and the appropriate legal measures shall be taken. 17. Mileage: On the Maltese Islands: unlimited per lease period. All other authorised territories: 300 km per day within the lease period, up to a maximum 3,000 km. Only if this is exceeded or the Vehicle is used once the Contract has been concluded, will an additional €0.4/km, including VAT be charged. 18. Additional services and extras: Speedy Check In: this is the fast delivery service of the Vehicle and each service costs €18. Delivery: This service has to be confirmed previously by the Lessor. Prices are established according to the distance from RENTAL COMPANY branch to the place of delivery or collection. Delivery Zone 0 (Airport) €20. Delivery Zone 1 (Between 0 and 20 Km) €35. Delivery Zone 2 (Between 21 and 40 Km) €45. For distances over 41km, 1€ per Km will be charged. Delivery price is per way. Delivery service subject to availability. 18.1. Extras: The Lessor offers child and baby seats, has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. GPS: has a minimum cost of €10, once this minimum has been exceeded €7 per day will be charged until reaching a maximum of €100, without going over this amount. 19. Payment: All services must be paid for in advance by credit card (VISA or MASTERCARD), debit card or in cash in our premises. If the Lessee wishes to pay in cash, for security, they must pre-authorise a security deposit of 100% with respect to the deductibles and conditions established in point 9 and 9.2. Payment of reservations on our website may only be made using credit or debit card above-mentioned. The method of obtaining said security deposit and the deductible will only be through the credit card provided by the Lessee to the Lessor or the additional driver appearing on, and who has signed, the Contract. Return of the deductible and Security Deposit or Pre-authorisation may take between 14 and 31 days depending on the bank used and the operating conditions of the Lessee's bank. RENTAL COMPANY only accepts VISA and MASTERCARD credit cards and does not apply any surcharge. 20. Currency: The rates established by the Rental Company are valued in Euros (€) and can be converted in any other currency using the following converter: https://www.google.com/finance /converter, not being liable for any conversion error. Payment can be made in all our facilities in the currency of the contract, solely with the credit cards established in the previous point. 21. Taxes: All prices detailed in the rates include the corresponding VAT. The Rental Company is exempt from the payment of any other taxes that any state, regional or local authority may establish in the course of this Agreement. 22. Jurisdiction and Applicable law: This contract is governed by all of the National Legislation which is relevant to it. The Parties expressly submit to the Courts of Malta for any incidents and matters which arise from this contract, except for those regarding consumer goods which will be governed by the jurisdiction established in their own regulations. 23. Cancellation policy: All cancellations must be made in writing to the following e-mail address: [email protected] , indicating the booking number in the subject. In Refundable Rates, a refund will be made at least with 48 hours(Depending on the rate) prior to the start day of the booking, except for reasons of force majeure (natural catastrophe, wars, terrorist attacks, death or sudden serious illness of the Lessee, his/her parents, siblings or children), reliably accredited via web, email or ordinary mail. In Non-Refundable Rates, no refund will be made except for reason of force majeure. 24. Customer service and claims: If you want to make any suggestions about improvement of our services, you can use the email: [email protected] additionally, all our facilities have official complaint sheets which will be given to you when requested to our employees. 25. Framework agreement: The present conditions have the consideration of framework agreement, being applicable to all rental agreements signed between the Renter and the Rental Company. 26. TRANSLATION: The Renter has the right to receive a copy in official language of the present General Conditions and this shall be stated in its versions written in other languages, informing you in our facilities of all the languages we have available at that time. In the event of any discrepancies, the prevailing version shall be the English version. 27. PRIVACY POLICY. III. PROCESSING OF PERSONAL DETAILS. INFORMATION ON DATA FILING SYSTEMS AND PROCESSING. In accordance with Regulation 2016/679 (the General Data Protection Regulation - GDPR), you are informed that the personal data here gathered will be included in filing systems of which the data controller is ZING RENTAL LIMITED. The personal details collected in relation to a query or request shall be handled to process it, and, where applicable, contact you in relation to this. THIRD-PARTY DETAILS.- If personal details owned by third parties are provided, you state that you have the consent of the affected parties for this and have previously informed them of the content of this privacy policy. COMMERCIAL COMMUNICATIONS. I expressly agree that the data contained in the Contract may be transferred to keep me informed either by email or by any other means as to operational and commercial information and the execution of opinion studies as to products and services offered by ZING RENTAL LIMITED, or entities in the same sector with which it collaborates, in connection with the leisure, insurance, financial and automotive sectors. Further details as to our privacy policy may be consulted on our website. RIGHTS OF THE INTERESTED PARTY. Those affected may exercise their rights of access, rectification, restriction, erasure and objection by writing, enclosing a copy of their identity document, to the aforementioned postal address or the email address: [email protected] Renter’s signature on the Agreement shall be considered as acceptance of the General and partic Conditions specified in the agreement.
